PC7~F-14b ~_ _ A RESOLUTION OF THE C[TY PLANNING COMMISSION OF THE ~ITY OF ANAHEIM THAT PETITION FOR CONDITIONAL USE PERMIT NO. ~~BE GKANTED WHEREAS, the City Planning Commission of the City of Anaheim di~ reccive a verified Petition for Conditional Use Permit from JOHN PENNINO, 7429 Via Amorita, Downey, California 90241 (Qwner); JACK VAN HAASTER, 350 West Katella Avenue, Anaheim, CaliPornia 92802 (Agent) of certain real property situated in the City of Anaheim, County of Ora~ge, State of California, as described in Exhibit "A" attached herei:o and referred to herein as though set forth in full ;and WHEREAS, the City Planning Commtssioa did hold a publie hearing in t~e City Hall in th? City of Anaheim on J u 1 y 8,~ 1974, at 2; 00 o'clock p.m., notice of said public hearidg having been duly given as iequired by law and in accordance with the•provisions.of the Anahelm Municipal Code, Chapter 18.64, to.hear ~hd consider evidence for and against said proposed condifional use and to investigate and make findings and reaommendations in connect~on therewith; and WHEREAS, said Commission; after due insp@ction, investigation, and study made by itself and in its behalf, and after due consideration of ali evidence and repor.s offered at said fiearing, does find and determine the following facts: I. That the proposed use is properly one for which a Conditional Use Pennit is authorized by Coda Sect i on 18. 37 • 020C i3, to wit: establish an automobile rental agency .in cor,junction with an Existing carwash a~d gasoTine sale5 facility. 2. That the petitioner stipulated there.would be no display of automobiles along the frontage of tfie subject property on Katella Avenue: 3. That the petitioner stipulated there would be no retail sales of automobiles at the subject location. 4. That the petitioner stipulated that all signs would be in conformance with the Sign Ordinanc:e. S,That the proposed use will not adversely affect the adjoining land uses and the growth and development of the area in which it is proposed to be located. 6,That the size an'd shape of the site proposed for the u:;e is adequate to allow the full devclopment of the proposed use in a manner not detrimental to fhe particular area nor to the peacc, health, safety, and genethl welfarc of the Citizens of the City of Maheim. ~.That the grantingof tha Conditionzl Use Permif under the conditions imposed, if any, will not be detrimencal to the peace, health, safety, and general welfare of the Citizens of the Ctty of Anaheim. 8. Th~at no one appeared at said pu6llc•hearing and no correspondence was received, in opposition to subject petition. EIJV I RO~JMENTAL I MPACT REPORT F I ND I NG : That the Director of Development Services has determined that the proposed activity falls within the definition of Section 3.01, ~lass l,of the City of Anaheim Guidelines to the Requirements for an Environmental Impact Report and is, therefore, categorically exempt from the requirement to file an EIR. (2) That trash storage areas shall be provided in accordance.with approved plans on file with the Office of the Director of Public Works. (3) That subject property shall be developed substantially in accordance with plans ~ind specifications on file with the City of Anaheim marked Exhibit No. l.. (4) That Condition Nos. 1, 2, and 3, above-mentioned, shall be complied.with p:rior to the commencement of the use granted under this resolution. (5) Tnat there shall be no display of automobiles along the frontage of the subject property on Katella Avenue, as stipulated to by the petitioner. (6) That there shall be no retail sales of automobiles conducted on the subject property zs stipulated to by the petitioner.
