USE PERMIT N0. ~~BE GRANTED WHEREAS, thc City Planning Commission of the City of Anaheim did receive a veriCed Petition for Conditional Use Permit from GULF OIL COMPANY, 1840 East 17th Street, Santa Ana, California 92701 (Owner); PACIFIC OUTDOOR ADVERTISING COMPANY, Attn: Jay Kingiy,"1740 Narva Street, Los Angeles, California 90031 (Agent) of certain real property situated in the City of Anaheim, County of Orange, State of California, described as all of.Original Town Lot No. 49, as same is delineated upon the lands of Anaheim, recorded in Book 4, pages 629 ahd 630 of Deeds, records of Los Angeles, County, California ;and WHER:AS, the City Planning Commission did hold a public hearing in the City Hall in the City of Anaheim on J u 1 y 8, 1 ~ 74 , at Z; pp o'clock p.m., notice of said public hearing having been duly given as reauired by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.64, to hear and consider evidence for and against said proposed conditional use and to investigate and make findings and recommendations in connectinn therewith; and WHEREAS, said Commission, after due inspection, investigation, and study made by itself and in its behalf, and after due considcration of all evidence and reports offered at said hearing, does find and deterrrine the following facts: 1. That the proposed use is properly one for whicli a Conditional Use Pemiit is authorized by Code Sect i on . 18.64.020(3-f), to wit: permit the continued use.of an existing billboard with waivers of: a. SECTION 18.63.~30(a) - Permitted location (Billboards not permitted in the center city area) b. SECTION 18.63.050(c) - Maximum heiqht within 300 feet of a residential structure (7 feet parmitted; 6 feet proposed) 2. That the Planning Commission determined that this conditional use permit sheuld be granted for a period of one (1) year, retroactive to April l, 1974 and to expire on April l, 1975, at the end of which time the billboard shall be removed from the property. 3..That the proposed use will not adversely affect the adjoining land uses and the growth and development of the arca in which it is proposed to be locnYcd. 4.That the size and shape of the site.proposed for the usc is adequate to allow the full development of the proposed use in a manner not detrimental to the particular area nor to the peace, health, safety, and general welfarc of the Citizens of the City of Mahcim. 5. That the grantingof the Conditionnl.Use Permit under the conditions imposed, If any, will not be detrimental to the peace, health, snfety, and general welfare of the Citizens of the City bf Anaheim. 6. That no one appeared at said public hearing and two (2) letters were :-eceived, ;~ opposition to subject petition. ENUIRONMENTAL IMPACT REPORT FINDING: That the Director of Development Services has determined that the proposed activity falls wiChin the definition of Section 3.01, Class 3 of the City of Anaheim Guidelines to the Requirements for an,EIR and is, therefore, categorically exempt from the requirement to file an EIR.
