PC74-150 ~ A RESOLUTION OF THE CITY PLANNING COMMISSION OF1475 CITYGRANT DHEIh1 THAT PETITION FOR CONDITIONAL USE PERMIT B~ WHEREAS, the City Planning Commission of the City of Anaheim did receive a verified Petition for Con- ditional Use Permit fram SPONSORS., INC. ~ Attn: ROY OTSUJI~ 224 North Glassell Street~ Orange, California 92666 owner of'certain'real property situated in the City of Anaheim, CounL-y of Orange, State of California, described as Lot 19 of the Norther.ly h'alf of Lot 20 in Block "A" of the Center Tract, as recorded in Book 14, page 13 of Miscellaneous Records of the County Recorder of Los Angeles County. ; end WHEREAS, the City Plenning Commission did hold a public hearing et the City fiall in the City of Anaheim on July 22, 1974, at 2:00 o'clock P.M., notice af said public hearing having been duly given es cequired by law and in accordance with the provisions of the Anaheim Municipe] code, Chapter 18.64, to hear and consider evidence for and against seid proposed conditional use and to investigete and make findings and recommendations in connection therewith; end • WHEREAS, said Commission, efter due inspection, investigation, and study mede by itself end in its be- half, and after due consideration of nll evidence esd reports offered et seid hearing, does find and detecmine the following fects: 1, Thet the proposed use is propecly one for which a Conditionel Use Permit is euthorized by COde Section 18.64,020(3)(k), to wit: continue tte operation of a half-way house for persona with alcoholic and drug-related pro6lems. 2. That the subject property is located within the Anaheim Redevelopment Project Ar•ea Al.pha end within the approved area for the Civic Center Complex, however, it was determined thaC subject property is not located witnin the Phase I area of the Civic Center Complex. 3. That Che petitioner indicated that en offer to sell the subject property hnd been sent to the Community Redevelopment Commission a.n.d lhat a reply had not yet been rtceived. 4. That it was determined that the existing structure should be broughC into conformance with the BuiTdl.ng Codes for an H-occupancy and the cost~ to do so would be minimal. 5. That che petitioner ir~dicated that the maximum occupancy for the proposed use of subject property would be thirteen (13) persons, including the two (2) resident staff membera. 6. That it was determined that the proposed use should be granted for a period of two (2) yeara, subject to review and consideration for extension of time by the Planning Commission and/or City Council upon requcst by the petitioner. 7. That the proposed use will not adversely affect the adjoining lan3 uses and the growth and development of the area in which it is proposed to be located. S. That the size and shape of the site proposed for the use is adequate to allow the full development of the proposed use in a manner not detrimental to the particular area nor to the peace, health, safety, and general welfare of the Citizens of the Cicy of Anaheim. 9. That the granting of the Condttional Uae Permit under the conditiona imposed will not be detrimental to the peace, health, safety, and genera].~oelfare of thQ Citizens uf the City of 3naheim. 10. Thal•one person indicated her presence in opposition at Che public hearing scheduled on June 24, 1974, and no correspondence was received in opposition to subject petition. ENVIRONMENTAL IMPACT REPORT FINDING: That the Directox of Development Services has determined that the proposed activiCy falls within the definition of Section 3.01, Class 1 of the City of Anaheim Guidelines to the Requirements for an Enviromnental Impact Report and is, therefore, categorically exempt from the requirement to file an EIR. PC74-150 ' ~' ~ ~ NOW, THEREFORE, BE IT RESOLVED thet the Anaheim City Planning Commission does hereby grent subject Petition tor Conditionel Use Permit, upon the [ollowing conditions which ere hereby Eound to be a necessery prerequisite to the proposed use oE the subject property in order to presecve the se:ety end genecal welfere of the Citlzens of the City oE Aneheim: 1, 'That the o~mer(s) of subj~t.property shall pay to the City of Anaheim che sum of 60F per front foot along Claudina Street for tree planting purposes, 2, That trash storage areas shall be provided in accordance with approved glans on file with che0f.fice of the Director of Public Works. 3. That the existing structure shall be brought up to tte.minimum standards of the City of Ar.aheim, including the Uniform Building, Pl~mbing, Electrical, Rousin~ Mechanical and Fire Codes as adop~ed by the City of Anaheim for an H-occupancy. 4. Thac subject property shall be developed substantially in accordance with plans and specLfications on file with the City of Anaheim marked Exhibit Nos, 1, 2, and 3. 5. That Condition Nos. 1 and 3, above-mentioned, shall be complied with within a period of sixty {60) days from the date of this resolution. 6. That CandiCion Nos, 2 and 4, above-mentioned, shall be complied with prior to final building ~r.d zoning inspections. 7. That this conditiona'i use permit is granted for a period of two (2) years, subject to review and consideration Eor extension of time by thePlanning Commission and/or City Council, upon request by the petitioner.
