A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CTTY OF ANAHEIM
THAT PETITION FOR VARIANCE NO. 2618 BE GRANTED
WHEREAS, the City Flenning Commission of the City of Aneheim did receive a veri~ed Petition foc Variance
Erom DUNN PROPERTIES CORP,, 2009 East Edinger Avenue, Santa Ana, California 92702 (Owner};
and RON BURT, 1833 South State College Boulevard, Anaheim, Californie 92806 and W.B. BURIZE,
1833 South State College Boulevard, Anaheim, California 92806 (Agents) of certain real
property situated in the City of Anaheim, County of Orange, State of California, described
as follows:
That portion of the East half of the NorCheast quarter of the Northeast quarter of Section 2E}
Towr.ship 4 SouCh, Range 10 West, in the City of Anaheim, as said section is ahoc•m on a map
thereof recorded in book 51, page Z0, Miscellaneous Maps, records of said Orange Cuunty and
more particularly shown as Parcel 4 on a Parcel Map recorded in book 45, page 13 of Parcel
Maps, re.•:rds of said Orange Cuunty.
NOTE: Ssid land is described on the County Tax Assessment Roll for the fiscal year 1973-74

WHEREAS, the City Plen~ing Commission did hold a public hearing At the City Hnll in the City of Anaheim
on July '12, 1974, at 2:00 o'clock P.M., notice oE said public heering heving been duly given c+s required
by law and in eccordance with the provisions o[ the Maheim Municipal Code, Chnpter 18.68, to hear end consider evi-
dence for and egeinst seid proposed variance end to investigete and meke findings and rernmmendetions in connection
thecewith; ond
NHEREAS, soid Commission, after due inspection, investigetion, and study mede by itself and in its behalf,
and after due rnnsideretidn of all eridence end repocts offered at said hearing, does find and detecmine the fol'owing
facts:
1. That the petitioner requests the following variance from the Anaheim Municipal Code, to
construcr. e commercial office building:
SECTION 18.52,020 - PermitCed uees. (Commercial officea serving the general public
not permitted)
2, That the above-mentioned waiver is hereby granted on the basis that similar waivers
have been granted in Che past, and eaid uses have not been detrimental to the 3urrounding
indust:cial lend uses; provided, however, thet the uses shall be reviewed and approved purauant
to Condition No, 9 of this resolution.
3. That the petitioner stipu].ated that rental officea would not generally be made
available to physicians and dentists due to the location and to the incre~sed number of
parking apaces which would be needed.
4. That it wae determined that the granting of this var3ance should be made aub~ect t~
the petitioner requesting termination of Conditional Uae Permit No, I432.
5, Thet there are exceptionel or extreordinary circumstances or conditions applicable to the property involved
or to the intended use of the property thet do not epply generally to thr, property or class of use in the same vicinity and
zone.
6, . Thet the requested verience is necessary for the preservation end enjoyment of a substantiel property right
possessed by other property in the same vicinity end zone, and denied to the property in question.
7, Thet the requested veriance will not be materielly detrimentel to the public welfere or injurious to the prop-
erty or improvements in such vicinity and zone in which the property is located.
8. That no one was present at said public hearing in opposition, and no correaponJence
was received in opposition to aubject petition.
ENVIRONMENTAL IMPACT REPORT FSNDING:
That the Planning Commission recommesda to Che City Council that the subjECt property be
exempt from the requirement to prepare an Environmental Impact Report pursuant to the pro-
vis3ons of the California Environmental Quality Act,

rOW, THr.REFORE, BE IT RESOLVED that the Anaheim City Planning Commission does hereby
grart: subject Fetition for Variance, upon the following conditions which are hereby found
to be a ~ecessary prerequisite to the proposed use of the sub~ect properCy in order to preserve

Ceitd:tioual Use Permit No. 1432.

bv ~he Director of Public Utilities, and in accordance with standard plans and specifications
on fil.e in tl~e Office of the Director of i'ublic Utilities and that a bond in an amount and

3. That trash storage ereas shall be provided in accordance with approved plans on
