THAT PETITION FOR CONDITIOt1AL USE PERIIIT BE GRANTED
WHEREAS, the City Planning Commission of the City of Anaheim did receive a verified
Petition for Conditional Use Permit from RAPT COMPANY, c/o PENP~IMAN AND COMPANY, 17802

NHEREAS, the City Planning Commission did hold a public hearing at the City Hall in th~ Cily of Anaheim
on Aug~st $, 1974, at 2:00 o'clock P.M., notice of said public hearing having 6een duiy given
as required by law and in accocdance with the provisions of the Anaheim Municipal code, Chapter 18.64,to hear •
and consider evidence for and against said pcoposed conditional use and ta investigate nnd make findings and
recommendations in connection thecewith; and
WHEREAS, said Commission, after due inspection, investigation, and study made by itself end in its br
halE, and aEter due consideration oE all evidence and reports o[(eced at said hearing, does find and determine the
following Eacts:
1. That the proposed use is properly one [or which a Conditional Use Permit is authorized by Code Sect i o7
i8.64.020(3)(j), to wit: permit a public skill driving course.
2, Tha*_ the Fetitioner stipulated to directing ail lighti^g away from the Anaheim
Stadi~m a;;d the freeNay, and that a lighting plan shall be si~bmitted for review and
approvai by the City.
3, lhat the petitioner stipulated to hold the City harmlesa from the effects of
ligh:i~g at the Ar,aheim Stadium, as long as the lighYing is controlled in the basic ~nar,~er
it is prese~tly controlied.
4. That it i~ras determined that the landscaping along the south prorerty iine shali
be den<.e to provide addttional sourid attenuatio~ for the proposed use.
5, That it was determired that the noise level on the south side of the railroad
tracks adjace~t to the south property line of the subject property shall not exceed 60 dDA
for the proposed usc.
6. That the petitior.er indicated the hours of oFeration would be froT 11:00 a.m. to
11:00 p.m. on Fridays, Saturday; and Sundays, and during the rerrai~der o~ the week they
would close no later th~n 10:00 p.m. ,
7, That the proposed use will not ad•aersely affect the adjoin~ng tand uses and the
growth and development of the area in whihh it is Frrpo=ed to be iocated.
8. That the size and shape of the site proy,osed for the use is adequate to allow
the full devclopment of the prcposed use in a manner rot detrimer,tal to the particular area
nor to the peace, health, sarety, and general welfare of the Citizers of the City oT
Anaheiro.
9. 7h~t the granting o` the Conditional Use Permit under the cor,ditions impo5ed, ir
any, wiil not be detrimentai to the peace, health, safety, and ger.eral welfare of the
Citizens of the City of Anaheim.
10. That no one indicated their presence in oppositio~ to subject petitior; however,
re~re>entatives from the Anaheim SLadi~m and Califo m ia Angels provided irput far consid-
era[ion by the Planning Commission.

. NOW, THEREFORE, BE IT ~OLVED that the Anaheim City Pl ~ng Commission does hereby
grant subjsct Petition for nditional Use Permit, upon the ~lowing conditions which are
hereby found to be a necessary prerequisite to the ;aroposed use of the s~bject property in
order to preserve the safety and general welfare of the Citizens of the City of Anaheim:
1. That the owner(s) of subject properT.y shall pay to the City of Anaheim ~he sum of
two dollars ($2.00) per front foot along Katella Avenue for street lighting purposes.
2. That trash storage areas shall be provided in accordance with approved plans on
file with the office of the Director of Public Works.
3, That fire hydrants shall be installed and charged as required and determined to be
necessary by the Chief of the Fire Department prior to commencement of structural fr•aming.
4. That subject property shall'.be served by underground utilities.
5. That drainage of subject property shall be disposed of in a manner satisfactory to
th~e City Engineer.
6. That the final parking plan shall be approved by the Deveiopment Services Departmen~
an~i any landscaped areas in the parking area shall be protected with 6-inch high concrete
curi•~, and concrete wheel stops shall be provided in parking spaces.
7. That all Iighting for the proposed development shall be directed away from Anaheim
Stadium and the freeway, and that a lightiny plan shall be submitted for review and approval
by the City, as stipulated to by the petitioner.
8. That final development plans, including a detailed landscaping plan, shall be sub-
mitted for review and approvaT by the Planning Commission; and said iandscaping along the
south property line shall be dense to provide additional sound attenuation.
g. That subject property shall be developed substantially in accordance with plans
and specifications on file with the City of Anaheim marked Exhi~it Nos. 1, 2 and 3.
10. That Condition Nos. 1, 7 and 8, above-mentioned, shall be complied with prior to
the commencement of the activity authorized under this resolution, or prior to the ti.me that
the building permit is issued, or within a period of one (1) year from date hereof, which-
ever occurs first, or such further time as the Flanning Commission or City Council may
grant.
11. That Condition Nos. 2, 4, 5. 6 and 9, above-mentioned, shall be complied with prior
to finai building and zoning inspections.
12. That the noise level on the south side of the railroad tracks adjacent to the
south property line of the subject property shall not exceed 60 dBA for the proposed use.
13. That the City shall be held harmless from the effects frcm lighting at the Anaheim
Stadium, as long as the lighting is controlled (n the basic manner it is presently con-
trolled, as stipulated to by the petitioner.
