Box 11485, Santa Ana, California 92711 (AgPnt) of certain real property situated in the City of Anaheim, County of Orange, State of California described as the East half of the West nalf of the Northeast quarter of the Northwest quarter of Section 24, iownship 4 South, Range 10 West, in the Rancho San Juan Cajon de Santa Ana, as shown on a Map recorded in Book 51, Page 10 of Miscellaneous Maps, records of Orange County, California. Excepting therefrom that portion thereof lying Northerly of the following described line: Beginning at a point in the Westerty line of said East half, distant South 00° '3' 43" East 659.40 feet from the Northwesterly corner thereof; thence South 89° 58' 35" East 330.03 feet to a point in the Easterly line of said East half, dis*_ant South 0° 13' S9" East 659•12 feet from the Northeast corner thereof ; end WHEREAS, the City Planning Commission did hold a public heering et the City Hall in the City of Aneheim on AuguSt 59 1974~ at 2:00 o'clock P.M. nctice of seid public heering having been duly given as cequired by law and in accocdan~e wi;h the provisions of the Anaheim Nunicipal Code, Chepter 18.72, to hear and considerevidence for and ageinst said pioposed reclessification and to investigate and make findings and recommendations in connection therewith; and WHEREAS, said Commission, after due inspection, investigation, and study made by itsetE end in its behalf, and eftec due consideretion of all evidence end ceports offered at said hearing, does Eind and determine the Eallowing fects: 1. That the petitioner proposes e reclessificetion of the above described property Ecom the R-A (AGR I CULTURAL) ZQNE to the M-1 (LIGHT iNDUSTRIAL) ZONE, 2. That the Anaheim General Plan designates subject property for industrial uses. 3, That subject property is currently zoned County of Orange R3-1200 (Apartment) District; and annexation to the City of Anaheim and reclassification to the R-A • (Agricultural) Zone are pending. 4. Thet the pcoposed reclassification of subject property is necessary and/or desicable for the orderly and pro- per development of the community. 5. Thet the proposed ceclassificetion of subject property does properly relate to the zones and their permitted uses locally esteblished in close proximity to subject pcoperty a~~d to the zones nnd their permitted uses generally estab- lished thcoughout the community. 6. That the pr~posed reclassification of subject property requires the dedication and improvement of abutt~ng streets/alleys in accordance with the Circulation Element of the General Plan, due to the anticipated increase in traffic which will be generated by the intensiflcation of land use. 7. That no one indicated their presence at said public hearing in opposition, and no correspondence was received in opposition to subject petition. ENVIRONMENTAL IMPAC7 REPORT FINDING: ' That the Planning Commission recommends to the City Council that the subject project be exempt from the requirement to prepare an Environmental Impact Report, pursuant to the provisions of the California Environmental Quality Act. RESOLUTIUN N0. PC74-158 R-A "1' ' ~ NOW, THEREFORE, BE IT ~OLVED that the Anaheim City Pl~ing Commission does hereby recortmend to the Ci:y Council of the City of Anaheim that subject Petition for Reclassi- fication be approved and, by so doing, that 7itle 18-Zoning of Yhe Anaheim Murroicipal Code be amended to exclude the above described property from the R-A (AGRICULTURALj ZONE and to tncorporate s~id described property into the M-1 (!IGHT INDUSTRIAL) ZONE upon the following conditions which are her~by feund to be a necessary prerequisite to the oroposed ~se or subject property in order to preserve the safety and general welfare of the Citizens of the City of A~aheim: l. That the owner(s) of subJect property shall deed to the City of Anaheim a strip of land 32 feet in width from the centerline of the street alon9 Winston Road for street widening purposes. • 2. That all engineering requirements of the City of Anaheim along Winston Road, i~cluding preparation of improvement plans and installation of all inprovements such as curbs and gutters, sidewalks, street gradi~g and paving, drainage facilities, or other ap~urtenant work shall be complied with as required by the City Engineer and in accord- ance with standard plans and specifications on file in the office of the City Engineer; that street lighting facilities along Winston Road shall be installed as required by the Direr.tor of Public Utilities and in accordance with standard plarts and specifications on file in the Office of the Director of Publtc Utilities; and that a bond in an amount and form satisfactory to the City of Anaheim shall be posted with the City to guarantee the irstallation of the above-mention~d requirements. 3. That trash storage areas shall be provided in accordance with approved plaris or, rile with the Office of the Director of Public Works. 4. That fire hydrants shall be installed and charged as required and determined to be necessary L•~;~ the ChieT of the Fire Department prior to commencement of structural framing. 5, That subJect property st~all be served by underground utilities. 6. That drairage of subJect property shall be disposed of in a manner satisFactory to the City Engineer. 7, That these reclassification proceedings are granted subject to compl,etion of arnexation of subject pro~erty to the City of Anaheim. 8, That appropr(ate water assessment fees as determined by the Director of Public Utifities shall be paid to the City of Anaheim prior to..the issuance of a building permit. 9. That perpetuai easement agreements with the owners or lessees of the properties oroviding for circulation of trash trucks from one parcel to the other shall be submitted to the Cfty Attorney's Office for review and appr~val; then be filed and recor~ed tn the OfTice of the Orange County Recorder prior to issuance of a building permit, 10, That subJect property shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim marked EG~~beC`No~o er~nd Conditton 11, Prior to the introduction of an ordinance rezoiing J P P Y~ Nos, 1 and 2, above-mentioned, shall be completed. 7he provisions or rtghts granted by this resolutio~ shall become null and v~id by action of the City Council unless said conditions are complied with within one year from the date heceof, or such further time as the City Council may grant. 12. That Condition Nos. 3~ 5, 6 a~d 10, above-mentioned, shall be complied with prior to fi~al building and zoning inspections.
