A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM
RECOMMENDING TO THE CITY COUNCIL OF THE CITY OF ANAHEIM THAT
PETITION FOR RECLASSIFICATION N0. ~4'75'6 BE APPROVED
WHEREAS, the City Plenning Commission of the City of Aneheim did receive a verifi.ed Petition for Reclassifica-
tionfrom ORANGE COi;NTY BUUDHIST CHURCH, 909 Dale Street, Anaheim, Califor~ia g2804 (Owner);

described as the North 174.00 reet of the South 228.00 feet of the East 5 acres of the

WHEREAS, :he City Planning Commission did hold a public hearing ot the City Hall in the City of Aneheim on
August j, i974, at 2:00 o'clock P.M. notice of said public hearing heving been duly given as required by
law and in eccardance with the provisions of the Aneheim Municipal Code, Chapter 18.72, to hear and consider evidence
for end egainst seid proposed reclassification and to investigate and make findings end recommendetions in connection

WHEREAS, said Commission, after due inspection, investigetion, end study mede by itself end in its behalf, end
efter due consideration of all evidence end ceports offeced et said heecing, does find and determine the following fects:
1. That the petitioner proposes a reclas~ificetion of the ebove described property from the R-A (A6RICULTURAI.~
ZCNE to the C•-i ~GENERAL COMMERCIAL) ZONE,
2. That the petitioner stipulated to ~roviding trash storage areas in accordance with
City standards.
3. Thet the proposed reclassifice'?on of sub;ect property is necessery end/or desirable for the orderly and pro-
per development o` the community.
4. That the proposed :eclessification of subject property does properly relete to the zones end their permitted
uses locelly esteblished in close p;osimity to subjec: property end to the zones end their permitted uses generally e~teb-
lished throughout the community.
5. That tne proposed reclassiTication of sub;ect property require§ the dedication and
improveme~t of abutting streets in acco~~ance with the Circulation Element of the General
Plan, iiue to the anticipatad increase in traffic which will be generated by the intensifi-
catio~ of land use.
6. That no one indicated their presence at said public heartng in opposition and no
correspondence was received in ~pposition to subject petition; and that one letter wos
received in favor of subject petition.

That the Planning Cortrnission recomnends to the City C~uncti that the subject pro}~ct
be exenpt Prom the requirement to prepare an Environmental In~~act Report pursuant Yo the

, NOW, THEREFORE, BE I~ESOLVED that the Anaheim City ~nning Commission does hereby
recommend to the City Council of the City of Anaheim that subject Petition for Reclassifi-
cation be approved and, by so doing, that Title 18-Zoning of the Anaheim Municipal Code be
amended to exclude the above described property from the R-A (AGRICULTURAL) ZONE and to
T-c~r~orate sald de~cribed property into the C-1 (GENERAL COMMEP,ClAL) ZONE upo~ the follow-
ing conditions which are hereby found to be a necessary prerequisite to the proposed use of
subJec~ ~roperty in order to preserve the safety and general welfare of the Citizens of the
City of Anaheim:
1, That ali engineering requirements of the Clty of Anaheim alo~q Ball Road and
Dale Avent:e, 3nciudirg preparatiun of improvement plans and insta?lation of all improve-
men'_s 5uch as curbs and gutters, sidewalks, street grading and paving, drainage facilities,
nr o~her appurtenant work, shall be complied with as required by the City Engineer and in
accordance with standard plans and specifications on fiie in the office of the City
Engineer; that street lighting facilities along Ball Road and Dale Avenue shall be installed
as required by :he Director of Public Utilities and in accorda~ce with standard plans a~d
specifications on tile in the office of the Director of Public Utilities; and that a bond
in an amount a~d form satis`actory to tne City of Anaheim shall be posted with the City to
guaraniee the i~stallation o` the abovf:-mentioned requirements.
2, That the owner{~) of subject property shalt pay to the City of Anaheim the sum
or 60C per ~ront foot along Ba11 Road and Dale Averue for tree planting purpases.
3, 7hat trash storage areas shall be provided in accordance with approved plans on
file wtth the office of the Director of Fublic Works, as stipulated to by the petitioner.
4. That fire iiydra~ts shall be installed and charged as required and determined to
~e necessary by the Chief of the Fire Department prior to commencement of structural framing.
5. That all air-conditioning faci~ities shall be properly shielded from view and the
sound bu`rered from adjace;~t properties.
6. That subject property shall be served by underground utilities.
7. That a six-foot ma ~ nry wall shatl be constsucted along the north and west
Froperty lE~es.
8. ihat drai~age of subject Rroperty shall be disposed of in a manner satisfactory
to the City Englneer.
9. That a parcel ma~, to record the approved division of subject property, be
sutmitted to and approved by the City of Anaheim and then be recorded in the office of the
Orange Co~m~y Recorder.
i0. That the T~nai parking plan :-ha11 be approved by the Development Services
Gepartrne~t, a~d a~y landscaped areas i~ the parking areas shall be protected wtth six-inch
~~tgh concrete curb~, and concrete wF.eel stops shati be provided for parking spaces.
li. That a,:peopriate water assessment fees as determined by the Director of Public
U:11Tties shall be paid to the Ctty of A~aheim prior to the issuance of a butiding permit.
i2. T4e2 subJect pro~erty shall be developed substantCally in accordance with ~lans
a~d s~eciricat3ons on flie with the City of Anaheim marked Exhibit Nos. 1 and 2.
i3. Prior to the introduct.ior, of an ordinance rezoning subject property, Conditaon
Nos. 1, 2 end 9, above-mentioned, shall be completed. The provisions or rights granted by
this resolution shall becorrs null and void 6y action of the City Council u~less said
cor~d?:ions are comfilied with within one year from the dat~ hereof, or such furYher time as
thc City Council may grant.
14, That Condition Nos. 3, 5. 6, %. 8, 10 and 12, above-me~tioned, shall be compiied
with prior to finai building and zoning inspections.
