KIRKELIE, 937 North Lemon Street, Anah~eim, Caiifornia 92~605 ~Owna~r} of certain real pro~serty situated in the City of Anaheim, County of Oran,ge, State of Ca~ifornia described as Lot Nos. 31 and 32 of Tract No. 255 as recorded in Book ~4, Page 25 of Misceilaneous Maps in the office of the Orange County R~~coi•der ; and WHEREAS, the City Plenning Commission did hold a public hearing ~t the City Ha11 'in the Citq oE Aneheim on August 5, 1974, at 2:00 o'clock P.id. notice oE seid public hearing heving been dwly given as cequired by law and in eccordance with the provisions of the Anaheim Municipel Code, Chapter 18.72, to heer snd consider evidence for end against said proposed cAclessiEicetion and ta investigete and meke findings end recommendations i~ connection therewith; end WHEREAS, seid Commission, after due inspection, investigation, end study mede by itself and in its be~half, and ufter due consideration of all evidence und ceports offered at said hearing, does find and determine the following fects: 1. lhat the petitioner proposes a reclassiEication of the ebove described property fcom tD~e R-2 (MULTIPLE- FAM!LY RESIDENTIAL) ZONE to the C-0 (COMMERCIAL CFFICE) ZONE. 2. That the Anaheim General Plan designates subject property for commercial professional uses. 3. That the petitioner stipulated to moving the proposed building to fifteen (15} feet from the south property line in order to align it with adjacent commercial build- ings Co the west. 4~ That the proposed reclesaification of subject property is nECessary end/or desireble tor the orderly and pro- per development of the community. ' 5. Thet the pcoposed reclessificetion of subject property does properly rela:e to the zones and their permitted uses locally established in close proximity to subject property end to the zones anc4their permitted use~ generelly esteb- lished throughout the community. 6. That the proposed reclassification of subJect property requires the dedication and improvement of abutting streets in accorda~~ce with the Circulation Element of the Generai Plan, due to the anticipated increase in traffic which wiit be generated by the intensificatton of lanc! use. ENVIRONMENTAL IMPACT REPORT FtNDING; That the Planning Commission recommends to the City Council that the subject project be exempt from the requirement to prepare an Environmental Impact Report pursuant to the provisions of the California Environmental Quality Act. PC74-169 DEV-66•A f9~ NOW, THEEtEFORE, BE IT~ OLVED thet the Aneheim City Planni^~° mmission does hereby iecommand to the City Council of the City oP4Cneheim that subject PeUtion foc Reclasdl4E~etion be approved and, by so doing, that Title 18-Zoning of the Aneheim hlunicipal Code be amended ta exclude the above described propecty from the R-2 (MULTIPLE-FAMILY RESIDENTIAL) ZONE and to incorporate said described property into the C-0 (COMMERCIAL OFFICE) ZONE upon the following conditions which are hereby found to be a necassary prerequisite to the Rroposed use of suGJect property En order to preserve the safety and general welfare of the Citizens of the City of Anaheim: 1. That sidewalks shall be installed along Center Street as required by the City E;gi~eer and in accordance with standard plans and specifications on file in the office of the City Engineer. '•' 2. That the owner(s) of subject;property shall pay to the City of Anaheim the sum of 60C per rrort foot along Center Street for tree planting purposes. 3, That the owner(s) of subject qroperty shall pay to the City of Anaheim the sum of $2.00 per front foot along Center Street for street lighting purposes. 4. Th~t trash storage areas shall be provided in accordance with approved plans on file with the office of the Director of Public 1Jorks. 5. That fire hydrants shall be installed and charged as required and determined to be recessary by the Chief of the Fire Department prior to cortmencement of structur~l framing. 6. That all air-conditioning facilities shall be properly shielded from view and the sou~d buffered from adjacent properties. 7. That subject property shall be served by underground utilities. 8, That a 6-foot masor.ry wail shall be constructed along the north property line. g, That drainage of subject property shall be disposed of in a manner satisfactory to the City Engineer. 10. That subject property shall be developed substantially in accordance with plans and specifications on file w.ith the City of Anaheim marked Exhibit Nos. 1, 2 and 3; provided, however, that the proposed building shall be set back to fifteen (15) feet from the south property line, resultin9 in a five (5) foot landscaped setback along the north ~roperty line, as stipulated to by the petitioner. 11. Prior to the introduction of an ordinance rezoning subject oroperty, Condition Nos. 2 and 3; above-mentioned, shall be completed. The provisions or rights granted by this resoiution shall become null and void by action of the City Council unless said conditions are complied with within one year from the date hereof, or such further time as the City Council may grant. 12, That Condition Nos. 1, 4, 6, 7, 8, 9 and 10, aboe~e-mentioned, shall be complied with prior to rinal building and zoning inspections.
