THAT PETITION FOR CONDITIONAL USE PLRMIT 8 BE
WHEREAS, the City Planning Commission of the City of Anaheim did receive a verified Petition Eor Con-
ditional UsePermit from ROBERT P. Dll.°RE and RICHARD FARLEY, 34~ Bayside Drive "A", Newport
Beach, California 92660, (Owners); EVEREADY COLLISION SERVICE, Attn: Burt Ruttman, 1935
lJest Elm Place, Anaheim, California 92804, (Agent) of certair real property situated in
the City of Anaheim, County of Orange, State of California, described as Lot 9~in Tract
No~.~'4703, as'sliown on a map recorded. in Book 169, pages.:25 and'26 of Mi'scellarieous Maps,
records of Orange C~unty, California
; and
WHEREAS, the City Plenning Commission did hald a public hearing at the City Hall in the City of Anaheim
on A~gUSt 1 y~ 19]~+ at Q:00 o'clock P.M., notice of said public hearing having been duly given
es required by lsw and in accordance with the pcuvisions of the Anaheim Municipal code, Chapter 15.64,to hear
and consider evidence for and against seid proposed conditional use and to investigate end make Eindings and
recommend~tions in connection therewith; and
WHEREAS, seid Commissian, aEter due inspection, investigation, and study mede by itself and in its be-
halE, end aEter due consiGeration of all evidence and reports ofEeced at said heacing, does find and determine the
following facts:
1. Thet the pcoposed use is pcoperly one for which a Conditional Use Permit is authorized by Code
Section 18.52•~5~~1)(c), to wit: permit an auto patnting, body and fender repair
facility in an existing industrial complex.
2. That the petitioner stipulated that additional fire protection devices would
be provided, if determined to be necessary by the Fire Department and euilding Division.
3. That the petitioRer stipulated that all repair worl< would be done inside the
building; and that approximately seven vehicles would be stored on the outside of the
building.
4. That *_he petitioner indicated the proposal was not for an insurance impound
yard.
5. That the proposed use will not adversely affect the adjoining land uses and
the gr~wth and development of the area in which it is proposed to be located.
6. That the size and shape of the site proposed for the use is adequate to allow
the full development of the proposed use in a manner not detrimental to the particular
area nor to the peace, health, safety, and general welfare of the Citizens of the City
of Anaheim.
7. That the granting of the Conditional Use Permit under the conditions imposed, if
any, will not be detrimental to the peace, health, safety, and general welfare of the
Citizens of the City of Anaheim.
8. That no one indicated tneir presence at said public hearing in opposition
and no correspondence was received in opposition to subject petition.
ENVIRONMENI'AL {MPACT Rf.PORT FINDING:
Thet the Director of Development Services has dete-mined that the proposed
activity falls within the definition af Section 3•O1, Class 1 of the City of Anaheim
Guidelines to the Requirements for an Environmental Impact Report and is, therefore,
categorically exempt from the requirement to file an EIR.

NQW, THEREFORE, BE IT RESOLVED thet the Anaheim City Plenning Commission does hereby gcent subject
petition for Conditionel Use Permit, upon the following conditions which are hereby Eound to be a necessary pcerequisite
to the proposed use oE tF~e subject property in order to pcesecve the seEety end genecel welface of the Citizens of the
City of Ar.eheim:
(1) That subJect property shall be developed substantially in accordance with plans
and specifications on file with the City of Anahetm marked Exhiblt Nos. t and 2.
(2) TE~at the zxlsting structure shall be brought up to the minimum standards of the
City of Anaheim, including the Uniform Building, Plumbing, Electrical, Housing, Mechanical
and Fire Codes as adopted by the City of Anaheim.
(3) That additionai fi~e protection devices shall be provided, if determined to be
necessary by the Fire Department and Bu~lding Division, as stipulated t~ by the petitioner.
(4) That Condition Nos. 1, 2, and 3, above-mentioned, shall be complied with p+'tor
to the commencement of the activity authorized under this resolutlon or prior to the time
that the building permit is issued, or within a period of one yzar from date hereof,
whichever occurs first, or such fu~ther *_ime as the Planning Ccmmisslon may grant.
(5) That all repair work shail be conducted on the inside of the building and a
minimal number of vehicles shall be stored on the outside of the building, as stipulated
to by the petitioner.
