A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM

PETITION FOR RECLASSIFICATION NO. 4 BE APPRGVED
WHEREAS, the City Planning Commission of the City of Anaheim dId receive a verified Petition fur Reclassifica-
tionfrom SAM HAMILTON, LESTEL M. HAMILTON, AhID DAISY KAYE, c/o Roger Patterson, P. 0. Box
4745, Whittier, California 90607, (Owners) of certain real property situated in the City
of Anaheim, County of Orange, State of California, described as PA~CCEL 1: Lot 21 of
Tract No. 4g8, as per map thereof recorded in book 19, page 24 of Miscellaneous Maps,
records of said Orange County. Excepting therefrom the West 132 feet thereof. PARCEL 2:
Lot 1 of Tract No. 4g8, Berger Half-Acres, as per map thereof recorded in book 19, page
24 of Miscellaneous Maps, records of said Orange County. Exept~ng therefrom the West
60 feet thereof. Also excepting from said Parceis 1 and 2 that portion conveyed to the
State of California by deed recorded January 8, 1952 in book 2271, page 373 of Official
Records. And the Westerly half ~f L.ot 20 of Tract No, 498 "Berger Half-Acres" in the
County of Orznge, as per map recorded in book 19, page 24 of Miscellaneous Maps, in
the office of the County Recorder of said county.

WHEREAS, the City Planning Commission did hold a public hearing et the City Hall in the City of Anaheim on
August 19, 19]4 at 2:00 o'clock P.M. notice of said public hearing having been duly given es required by
Iaw and in ar.cordance with the provisions ef the Anaheim Municipal Code, Chepter 18.72, to hear end consider evidenct
fot end ageinst seid proposed reclassiEication and to investigate and make findings end tecommendetions in connection
tharewith; and
WHEREAS, said Commission, after due inspection, investigation, end study made by itself end in its behelf, end
nfter due considezation of all evidence and reports offered at said hearing, does find and determine the following Eects:
1. Thet the petitioner proposes e reclassification of the above described property fcom the R-A (AGR I CULTURAL)
ZONE to the C-1 (GENERAL COMMERCIAL) ZONE.
2. That the Anaheim Gereral Plan designates subject property for commercial-
recreation uses.
3. That the petitioner stipulated that the proposed access gate to Mountain View
Avenue would be for emergency purposes only, and that vehicular ingress and egress would
not be taken to the subject property from that street.
4' That the pcoposed reclassificetion of subject pcoperty is necessary and/or desireble for the orderly end pro-
per development of the community.
5, That the proposed reclassification of subject property does properly relate to the zones end their pernitted
uses locally esteblished in close proximity to subject property and to the zones and their permitted uses generally esteb-
lished throu¢~,oui th communit .
b. That t~e propo~ed reclassification of subject property requires the dedication
and improvement of abutting streets in accordance with tne Circulation Element of the
General Plan, due to fhe anttcipated increase in traffic which will be generated by the
intensification of land use.
7. That no one indicated their presence at said public hearing in opposition and
no correspondence was received in opposiCion to subject patition.
ENVIRONMENTAL IMPACT REPORT FINUIN6
That the Director of Development 6ervices has determined that the proposed activtty
falls within the definition of Section 3•01, Class 1 and 5 of the City of Anaheim Guide-
lines to the Requirements for an Environmental Impact Report and is, therefore,
categorically exempt from the requir~em=nt to file an EIR.

NOW, THEREFORE, BE IT RESOLUED that the Anaheim City Planning Commiss3on does
hereby recommend to the City Gouncil of Yhe City of Anaheim that subject PetiiEUn for
Reclassification be approved and, by so doing, that Title 18-Zoning of the Anahe3m
Municipal Code be amended to exclude the above described property from the R-A (AGRICULTURAL)
ZOPlE and to incorporate said described property into the C-t (GENERAL COMMERClAL) ZONE
upon the following conditions which are hereby found to be a necessary prerequisite to the
proposed use of subject property in order to preserve the s~fety and general welfare of the
Citizens of the Ciiy of Anaheim:
(1) That all engineering requirements of the City of Anaheim along Manchester Avenue
and Mountain Vi2w Avenue including preparation of improvement plans and installation of
all improvements such as curbs and gutters,sidewalks, street g~ading and paving, drainage
facilities, or other appurtenant work shall be complied with as required by the City
Engineer and in accordance with standard plans and specificatior:s on file in the offfce
of the City Engineer; that street li9hting facilities along Manchester Avenue and Mountain
View Avenue shall be installed as required by the Director of Public UtiliCies a~d in
accordance with standard plans and specif9cations on file 1~ the office of the Director
nf Public Utilities; and that a bond in a~ amount and form sarisfactory to the City of
Anaheim shall be posted with the City to guarar.tae the instalSation of the above-mentioned
requirements.
(2) That the owner(s) of subject property shall pay to the City of Anaheim the sum of
60~ per front foot along Manchester Avenue and Mountain View Avenue for tree planting
purposes.
(3) That trash storage areas shall be provided in accordance with approved plans on file
with the office of the Director of Public 4lorks.
(4) That t;ie proposed ac~ess gate to Mountain View Avenue shall be for emergency pur-
poses only, and that vehicular ingress ~~d egress shall not be taken to the subject
property from that >treet, as stlpulated to by the petitioner.
(5) T`~at drainage of subjec: property shall be disposed of in a manner satisfactory to
the City Engineer.
(6) That appropriate water assessment fees as determined by the Director of Public
Utilities shall be paid to the City of Anaheim prior to the issuance of a buitding permit.
(7) A parcel map to record ;he approved division of subject property shall be submitted
to and approved by the City of Anaheim and then be recorded in the office of the Orange
County Recorder.
(8j That tne existing structure shall be brought up to the minimum standards of the
City of Anaheim, including the Uniform Building, Plumbing, Electrical, Housing, Mechanical
and Fire Codes, es adopted by the City of Anaheim.
(9) That all air-conditioning facilitPes shall ~e properly shielded from view, and tha
sound buffered from adjacent properties.
(10) That any parking area lighting proposed shall be down-lighted from a maximum height
of o feet, which lighting shall be directed away from the property lines to protect the
residential integrity of the area.
(il) Prior to the introduction of an ordinance rezaning subJect properY.y, Condition Nos.
1, 2 and 7, above-mentioned, shall be completed. The provisions or rights granted by this
resolution shall become null and void by action of the City Council ur~less said conditions
are complied with within one year from the date hereof, or such further time as the City
Council may grant.
(12) That Condition Nos. 3, 5~ $, 9 and 10, above-mentioned, shall be complied with prior
to the commencement of Che activlty:authcrized under this resolution, or prior to final
building and zonfng inspecttons, or within a period of one year from date hereof, which-
ever occurs first, or such further time as the Planning Lommission or City Council may
grant.
