PC74-178 A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE C(TY OF ANAHEIM THAT PET1TfON FOR VARIANCE N0. 2629 BE GRANTED WHER~AS, thc City Planning Commission of the City of Anaheim did receive a verified Petition for Variancc from ENRIQUE AND GUADALUPE BECERRA, 1775 West Laurel Place, Anaheim, California 92801 (Owners) of certain real property situated in the City of Anaheim, County of Orange, State of California, described as Lot 138 of Tract 1591 as per map recorded in book 54 pages 36, 37, 38 and 39 of Miscellaneous Maps, in the~office of tha county recorder of said county; and WHEREAS, the City Planning Commission did hold a public hcaring at the City Hall in thc City of Analteim on August 19, 19]4 at 2:00 o'clock p.m., notice of ,aid public hearing having been duly gven as required by law and in accordance with the provisions of the Maheim Municipal Code, Chapter 18.E8, to hear and consider evidence for and against said proposed variance and to investigate and make f ndin6s and recommendations in connection therewiUi; and WHEREAS, said Commission, aftcr duc inspection, investigatio~, and study madc by itself and in its behalf, and aftcr duc consideration oC all evidence and reports o(fered at said hcaring, does find and determine the Collowing facts: 1. 7'! ~at the petitioner requests a variance from the Anaheim Municipal Code: to a 1 1 oW a del ay for eomp l l anee with the requirement that a two-car garage must be provided upon conversion of the original garage into a kitchen and famity room: SECTION 18.24.030(5) - Re uirement that two arkin s aces be ravided in a ara e. (7) That three (3) persons were present, two (2) of whom appeared, in opposition to subject petition. ENVIRONMENTAL IMPACT REPORT FINDING That the Director of Development Services has determined that the proposed activity fatls within the definition of Sectlon 3.01, Class 1 of the City of Anaheim G~idelines to the Requirements for an EIR and is, therefore, categortcally exempt from the require- ment to file an EIR. PC74-17£i DEV-66•E ' ~ ~ NOW, THERGFORE, BE IT RESOLVED thet the Aneheim City Planning Commission does heceby gwr.t subject Petition for Variance, upon the following ccnditians which ace heceby found to be a necessary precequisite to the pro- posed use of the subject property in occer to preserve the safety and generel welface oE the Citizens oE the Clty of Anaheim: , (1) That the existing structure shall be brought up'to tElectrical,SHousings Mech- the City of Anaheim, including the Unlform Building, Plumb.ng, anical and Fire Codes as adopted by the City of Anaheim. (2) That subJect property shalt be developed substantlally in accordance with plans and specifications on file with the Clty of Anahetm marked Exhibit Nos. 1 and 2. (3) That Condition Nos. 1 and 2, above°mentioned, shall be completed within thirty days or such further time as the Planning Commission may grant. (4) That this variance is granted for a perlod of two (2) years.
