A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ANAHEIM ADOPTING
AND RECOMMENDING TO THE CITY COUNCIL OF THE CITY ONOISEHELEh1ENTPTION
OF ANAHEIM GENERAL PLAN AMENDMENT N0. 133 -
WHEREAS, the City Council of the City of Anaheim did adopt a General Plan
by Resolution No. 6gR-644, showirg *_he general description and extent of land
uses ivithin the City and indicating the present belief of the Council as to
possible future development and redevelopment of land within the City; and
WHEREAS, a Noise Element of the Anaheim General Plan is required and,
pursuant to the California Government Code Section 63502(g), said Element shall
be in quantitative, numerical terms, showing contours of present and projected
noise levels associated with all existing and proposed major transportation
elements, including but not limited to (1) highways and freeways, (2) ground rapid
tra~sit s~~rstems, and (3) ground facilities associated with all airports operating
under a permit from the State Department of Aeronautics; and
WHEREAS, the 5tate of California adoption deadline for the Noise Element is
September 20, 1974; and
WHEKEAS, the Anaheim City Planning Commission did hold a public heari~g in the
Gity Hall in the City of Anaheim on August 19, 1974, at 2:00 p.m., notice of said
public hearing having been duly given as required by law and in accordance with the
provisions of the Anaheim Municipal Code, to hear and consider evidence for and
against said Amendment to the Anaheim General Plan, and to make findings and
recommendations in connection therewith; and
WHER[AS, said Commission, after due inspection, investigation and study made
by itself and i~ its behalf, and after due consideration of all evidence and
reports offered at said hearing, DOES HEREBY FIND:
1, That evidence was presentad at said public hearing which substantiates
the Planning Commission's recommending to the City Council the amend-
ment of the Anaheim General Plan by the establishment of a valid
Noise Element;
!, That the guidelines for preparation of the Noise E!ement, as issued by
the State of California Office of Planning and Research, include (a)
a 5tatement of general pelicy indicating the local jurisdiction's
general intentions regarding noise and noise sources in the community,
(b) desired maximum noise levels by land use categories, (c) standards
and criteria for noise emissions from transportation facilities - control
of some noise sources having been preempted by State and Federal
governments, (d) standards and c'riteria for compatible noise levels
for local "fixed-point" noise sources, (e) guide to implementation
and (f) appendix describing methodology of preparation and sources of data;
3, 7hat noise level contours for railroads are not available for inclusion
in said Noise Element, since the railroad companies have failed to furnish
the contours as required by the Government Code, and this matter has been
referred to the State Attorney General for resolution; and
4. That the State of California has provided large-scale maps indicating the
noise contours associated with freeways and said maps are an file in the
Development Services Department for reference.
NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission
recommends to the City Council that the subject document be exempt from the require-
ment to prepare an Environmental Impact Report pursuant to the provisions of the
California Environmental Quality Act.
BE IT FURTHER RESOLVED that the Anaheim City Planning Commission does hereby
adopt and rer,ommend to the City Council adoption of Anaheim General Plan Amendment
No. ~33 as the Noise Element of the Anaheim General Plan, on the basis of the
aforementioned findings and in accordance with "Exhibit A."
