PC74-182 A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY QF ANAHEIM AMENDIN6 CONDITIONS OF APPROVAL fOR CONDITIONAL USE PERMIT NOS. 1311 and 1329 WHEREAS, under Conditional Use Permit Nos. 1311 and 1329, the Planning Commission granted permission to reestablish a carwash and automobile service station at the southwest corner of Lincoln Avenue and State College Boulevard, and further described as 201 State College Boulevard; and WHEREAS, Conditional Use Permit No. 1311 was granted on June 12, 1972, in Resolution No. PC72-124 and the conditions of approval included the following condition relating to hours of operations: "(11) Tliat the hours of operation shall be from 8:00 a.m. to 8:00 p.m., and that said hours of operation shall be reviewed at the end of one year to determine whether or not there have been any detrimental effects to the adjacent residential uses and whether or not the hours are appropriately limited." and WHEREAS, Conditional Use Permit No. 1329 was granted on August 7, 1972, in Resolution No. PC72-180 and the conditions of approval included the following condition relating to hours of operations: ~~(llj That the hours of operation of the canvash shall be limited from 8:00 a.m. to 8:00 p.m. provided, however, that if the decibel reading exceeds the level acceptable to the residents in the area, the closing hour shall be 6:30 p.m.; that the hours of operation o'F the service station shall be from 7:00 a.m. to !0:00 p.m., as stipulated to by the petitioner; and that said operations shall be reviewed at the end of one year to determine whether there are any detrimental effects to adjacent residential uses and to determine if the hours of operation shall be amended." and 41HEREAS, petitioner has submitted a letter requesting rEView of the approved hours of operation of the carwash to permit amendment of said hours to 7:00 a.m. Co 9:00 p.m. for the carwash, and 6:00 a.m. to 12:00 midniglit for the service station; and WHEREAS, no canplaints have been received by the City regarding the subject operation; NOW, THEREFORE, BE IT RESOLVED that the Plannin9 Commission hereby amends the conditions of approval of Conditional Use Permit Nos. 1311 and 1329 as set forth in Resolution Nos. PC72-124 and PC72-180, respectively, to read as follows: ~~(11) That the hours of operatiors of the carwasYi shall be limited from 7:00 a.m. to 9:00 p.m. provided, hnwever, that if the decibel reading exceeds the level acceptable to the residents in the area, 'the closing hour shall be 6:30 p.m.; that the hours of operation of the service station shall be from 6:00 a.m. to 12:00 midnight; and thet said operations shal.l be reviewed at the end of six (6) months to determine whether there are any detrimental effects to adjacent resi- dential uses and to further determine if the hours of operation shall be amended; provided, however, if there are no complaints and no evtdence that the subject use is not canpatible ~+ith the adJacent residential uses, then the Gevelopnent Services Department shall administratively approve the continuance of the operatton for the hours set forth in this condition." _~_ ftE50LUTI0N N0, PC74-182 ~ ~ ~ _ THE fOREG0ING RESO;.UTION is signed and approved by me this 19th day of August, 1974.
