ThAt the petitioner proposes a reclessificetion of SubJ ect property f rom the R-A (AGR I CULTURAL) ZONE to the C-1 (GENERAL COMMERCIAL) ZONE, 2. That the Anaheim General Plan designates subJect prope,-ty for commercial-recreation uses. 3. Thet the proposed reclessificatl'an of sub;ect atnperty is necessery and/or desiroble forthe orderly end pro- per development of the community. 4. Thet the proposed reclassificetian of subject property does properly telate to the zones und their permi:ted uses locally esteblished in clqne proximity to subject property snd to the zones and their permifled uses generally esteb- lished throughout the community. 5. That tl~e proposed reclassification of subject property requires the dedication and imprevement of abutting streets in accordance wi~h the Circulation Element of the General Plan, due to the anticipated increase in traffic which will be generated by the intensification of land use. 6. That one (1) person appeared at said public hearing in opposition, whose opposition was subsequently withdrawn, and no correspondence was received in opposition to subject petition. ~NUIRONMENTAL IMPACT REPORT FINDING: 'ihat the Pla~ning Commissiun recommends to the City Council that the subject project be ex.e~~pt rrom the requirement to prepare an Environmental Impact Report pursuant to the provisions of the Ca~ifornia Environmental Quality Act. PC74-183 DEV-66•A ~ ~ ~ ~ NOW, THEREFORE, ~E IT RE50LVED that the Anaheim City Planning Commission does hereby recommend to the City Council of tlie City of Anaheim that subject Petition for Reclassificatim be approved ard, by so doing, that Title 18-Zoning of_tt~:Anaheim Municipal Code be amended to exclude the above described property from the R-A (AGRICULTURAL) ZONE and to incorporate said described property into the C-1 (GENERAL COMMERCIAL) ZONE upon the following conditions which are herby found to be a necessary prerequisite to the propased use of subject property in order to preserve the safety and general welfare of the Citizens of the City of Anaheim: l, That all engineering requirements of the City of Anaheim along Mountain View Avenue including preparation of improvement plans and installation of all improvements such as curbs and gutters, sidewalks, street grading and paving, drainage facilities, or other appurtenant work shall ba complied with as required by the City Engineer and in accordance with standard ptans and specifications on file in the office ` the City Engineer; that street lighting facilities along Mountain View Avenue shall be installed as required by the Director of Public Utilities and in accordance with standard plans and specificatinns on file in the office of the Director of Public Utilities; and that a bond in an amount and form satisfactory to the City of Anaheim shall be posted with the City to guarantee the installation of the above-mentioned requirements. 2. That the owner(s) of subject property shall pay to the City of Anaheim the sum of 60t per front foot along Mountain View Avenue for tree plantirtg purposes. 3, That trash storage areas shall be provided in accordance with approved plans on file with the office of the Director of Public Works. 4. That fire hydrants shall be installed and charged as required and determined to be necessary by the Chief of the Fire Department prior to commencement of structural framing. That subject property shall be served by und~rground utilities. 6. That drainage of subject property shall be disposed of in a manner satisfactory Co L•he City Engineer. 7, PYtor to the introduction of an ordinance rezoning subject property, Condition Nos. 1 and 2, above-mentioned, shall be completed. The provisions or rights grarted by this resolution shall become null and void by action of the City Council unless said conditions are complied with within one year from the date hereof, or such further time as the City Council may grant. 8. That Condition Nos. 3, 5 and 5, above-mentioned, shall be complied with prior to the commencement of the activity authorized under ~tiis resolution, or prior to the time that the building permit is issued, or within a pe~iod of one year from date hereof, whichever occurs first, or such further time as the Planning Commission or City Council may grr,nt.
