A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM
~THAT PETITION FOR VAR'IANCE N0. 2621 BE GRANTED I N PART
WHEREAS, the City Planning Commission of the City of Mahcim did receive a verificd Petition for Variancc from CRUZ
and MADELINE VAf~AS, 1839 Mountain View Avenue, Anaheim, California 92802 (Owners); CARLOS
VARGAS, 1II39 Mountai~ View Avenus, Ai~,~heim, California 92802 (Agent) of certain real property
situAted:in the City of Anaheim, County of Orange, State of California, described as Lot 11
of Tract 498, as per map recorded in book 19 page 24 of Miscellaneous Maps, in the office
of the county recorder of said county and Lot 12 of Tract 498, as per map recoi•ded in book
19 page 24 of Miscellaneous Maps, in the office of Lhe county recorder of said county; and
WHEREAS, the City Planning Commission did hold ~ public hearing at the City Hall in the City of Anahcim on
Septembe r 4, 1974, at 2:00 o'clock p.m., notice. of snid public hearing having becn duly ~ivcn as required by law and
in accordance wich thc provisions of the Anaheim Municipal Codc, Chaptcr 18.6$, to hear and considcr cvidence Cor and against said
proposcd variance and to invcstigatc and rt:uke fndings and recommcndations in connection therewith; and
WHEREAS, said Commission, after duc inspection, investigation, and study made by itsclf and in its behalf, and aftcr due
consideration of all evidence and reports offered at said hearing, does find and determine the following facts:
1. Thatthepetitionerrequesis.the following variances from the Anaheim Municipal Code, to
permit the continued use of an existing truck storagt yard and to construct a commercial
office building:
a, SECTION 18.04.030(b) - Minimum driveway width. (20 feet required; 1 1 Peet
proposed)
b, SECTION 18.05`J~5)~a) - Minimum front yard setback in the R-A Zone. (2 feet
required; 15 and 20 feet proposed)
c. SECTION 18.40.020 - Permitted uses in th~ '~1 2one. (Truck storage yard
not permitted)

2. That Waivers 1-a and 1-b, above-rtientioned, were withdrawn by the petitioner on
the basis of the revised plans in conformance with Code requirements and the initiation
of a request for C-1 Zoning instead of retaining the property in the R-A Zone.
3. That Waiver 1-c, above-mentioned, is hereby granted for a period of two (2) years,
subject to :•eview and consideration for extension of time by the Planning Commission and/or
Lity Council upon request by the petitioner at the end of said two years.
4. That Waivers 1-d and 1-e, above-mentioned, are hereby granted on the basis that
the trend for developmeni. in the immediate area is general commercial and, in the event
the surrounding parcels develop commercial, said waivers would no longer be necessary.
5. That the petitioner stipulated to compliance with the City standards for trash
storage areas, and that adequate corner cut-offs would be provided within the parking area
to accemmodate 'the'trash:cbllection•vefiicles.

6. That the petitioner stipulated to installing interwoven redwood or cedar slats
in the proposed gate across the entrance driveway.
7. That the petitioner stipulated that the storage yard would be used exclusively
for storage of trucks owned by the petitioner, said trucks not to exceed two-ton capacity,
and that no construction clean-up materials would be stored on the subject property.
8. That there are exceptional or extraodrinary circumstances or conditions applicable
to the property involved or to the intended use as granted of the property that do not
apply generally to the property or class of use in the same vicinity and zone.
9. That the requested variance as granted is necessary for the preservation and
enjoyment of a substantial property right possessed by other property in the same vicinity
and zone, and denied to the property in question.
10. That the requested variance as granted will not be materially detrimental to the
public welfare or injurious to the property or improvements in such vicinity and zone in
which the property is located.
11. That one (1) person appeared at said public hearing in apposition, whose
opposition was subsequently withdrawn and no correspondence was received in opposition to
subject petition.
ENVIRONMENTAL IMPACT REPORT FINDING:
That the Planning Commission recommends to the City Council that the subject project be
exempt from the requirement to prepare an Environmental Impact Report pursuant to the
provisions of the California Environmental Quality Act.
NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does hereby
grant in part subject Petition for Variance, upon the folloo-~ing conditions which are hereby
found to be a necessary prerequisite to the proposed use of the subl_ct property in order
to preserve the safety and general welfare of the Citizens of the City of Anaheim:
l. That this Variance is granted subject io the completion of Reclassification No.
74-75-10, now pending.
2. That subject property shall be developed substantially in accordance with plans
a~d specifications on file with the i,ity of Anaheim marked Exhibit Nos. 1(Revision 1) and
2 through 5; provided, however, that trash storage areas shall be provided in conforma~ce
to City standards and adequate corner cut offs shall be provided within the parking area
to accamioda~ trash collection vehicles, and interwoven redNOOd or cedar slats shall be
installed in the proposed gate across the entrance driveway, as stipulated to by the
petitioner.
3. 7hat this variance is granted for a period of two (2) years, and upon request
by the petitioner, an additional period of time mey be granted upon approval by the
Plannina Commission and/or City Council,
4. That the storage yard shall be used exclusively for storage of trucks owned by
the petitioner, said trucks not to exceed two-ton capacity, and that no construction
clean-up materials shall be stored on the subject property, as stipulated to by the petitiorer.
THE FOREGOING RESOLUTION is signed and approved by me this 4th da of tember, 1974.
