B~ GRANTED WHEREAS, the City Planning Commission of the City of Anaheim did receive a verified Petiticit for Conditional Us~ Permit from FIAAGEN DEVELOPMENT COMPANY, 777 Silver Spur Rcad, Rolling Hilis, California 90274 (Owner); ROCIO LADEAU, 766 West Cypress, Covina, California 91722 (Agent) of certain real property situatzd in the City of Anaheim, County of Orange, State of California, as described in Exhibit "A" attached hereto and referred to herein as though set forth in full ;and WHEREAS, the City Planning Commission did hold a public hearing in the City Hall in the City of Anaheim on Septembe r 4, 1974, at 2: 00 o'clock p.m., notice of said public hearing having been duly given as required by law and in accordanee with the provisions of the Anaheim D^.anieip&I Code, Chapter 18.64,to hear and consider evidence for and against said proposed conditional use and to investigate and make findings and recommendations in connection therewiQi; and \VHEREAS, said Commission, after due inspection, investigation, and study made by itselC and in its beha!f, and after due consideration of all evidence and reports offered at said hearing, does find and determine the folloK~ing facts: 1. That the proposed use is properly one for which a Conditional Use Pemiit is authorized by Code Sect i on 18. 40. 060 (g) , to wit: permit on-sale beer and wine, in conjunction with a restaurant in an existing comfnercial shopping center. 2. That Lhe petitioner stipulated that on-sale beer and wine would be in conjunction with the sale of food only, and that no bar was proposed to be a part of the operation. 3. That a similar use was previously approved in the subject area. 4.That the proposed use will not adversely affect the adjoining land uses and the growth and development of the area in which'st is proposed to be located. S.That the size and shape of tlie site proposed fo: tlie use is adequate to allow the full development of the proposed use in a mnnn^.r not detrimental to the particular area nor to the peace, health, safety, and genernl welfare of tlie Citizens of the City oi P.naheim. 6.That the grantingof the Conditional Use Pemiit under the conditions imposed, if any, witl not be detrimental to the peace, heslth, safety, and general welfare of the Citizens of the City of Anaheim. 7, ihat no one indicated their presence at said public hearing in opposition and no correspondence was received in opposition to subject petition.
