PC74-19 A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHE7Si RECOTIMENDING TO THE CITY COUNCIL OF THE CITY OF ANAHEIM AMENDMENT Z'0 TITLE 18, ANAHEIM D".UNICIPAL CODE, REPEALING CHAPTER lis,84 ENTITLED "BUILDING LINE SETEACKS" WHEREAS, Ordinance No. 771 dated December 12, 1950, established Chapter 18.84 entitled "Building Line Setbacks"; and WtI~REAS, the City Plannir.g Courtnission did hald a public hearing at the City Hall tn the City of Anaheim on Janu~ry 21, 2974, at 2:00 p.m., uotice of said pnblic hearing having been duly given as required by law, Co hear and conaider evidence for and against ~he proposed amendment and to investigate and make findings and recommendations in con- nection therawith; and idHEREAS, said Commission, after due inspection, investigation'y and study made by itself and in its behaif, and after due conai3eration of all evidence and reports offered at said hearing, does find and dEtermine the following facts: (1) Setback dimensions gi~~en in Chapter 18.84 correspond to the dimensions of the ultimate right-of-way widths for streeta listed within the chap- Cer as meas~red from the monumented centerline. Therefore, if Chapter Y8.84 were to be literally interpreted, buildings could be located ad- jacent to the right-of.-way of the liste3 streets without setback. (2) Building line aetbacks for all pr.opertiea adjacent to the streets listed Ln Chapter 18.84 are provided for in the site development standards of the underlying zones of the affected properCies. (3) Cha~cer 18.84 was adopted Decembcr 12, 1950 (Ord. 772) (prior to the adoption of the CircuTation Element o£ the General Plan) as a means of preventing development from encroaching 3nto ultimate street rights-of- way. (4) A Circulation Element for the General Plen was subsequently adopted June 18, 1960 (Res. 611). However, Chapter 18.84 was not rep~:aled con- current wikh the adoption of the Cirenlation Element as several of the streets listed in Chapter 18.84 were classified as either local or local collector streets ana, as such, were not included in the Circulation Elemer.t. (5) In the intervening ye9rs since the adoption of the Circulation Element, the street classification eystem has been continually "upgraded", and on October 30, ].973, the City Counc3l adopted Resolution No. 73R-50o in ccnjunetion with the appraval of General Plan Amendment No. 129; said C.eneral Plan Amendment consisting of a map and text of all propo9ed and previous amendments and changes *_o the G•.. 'ilation Element of the General P1an and the ulCimate right-of-way widths ror all streets listed in Chap- her Y8.84, thereby negating the reasone for retention of said chapter, NOjd, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Cc~mmission does hereby recommend to the City Council of the City of Anaheim en amendmenc to the Anal3eim Municipal Code, Title 18, Zuning, reFsaling Chapter 15.84 entitled "Building Line Set- backs" in its entirety.
