PC74-19~ . ~ P_ I2ESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OP ANAHE[M THAT PETITION FOR CONDITIONAL USE PERMIT N0. 1490 BL GRANTED WHEREAS, the City Planning Commission of the City of Anaheim did receive a verified Petition for Conditional Usc Permit from HENRY F. AND ETHEL C, DEL GIORGIO, c/o The McCarthy Company, 2535 West La Palma Avenue, Anaheim, California 92801 (Owners)• E. R, FULLER, c/o The McCarthy Compa~y, 2535 West La ?alma Avenue, Anaheim, California 92801 (Agent); of certain real property situated in_the City of Anaheim, County of Orange, State of Cal'ifornia, as described in Exhibit "A" attached hereto and referred to herein as fhough set forth in full ;and WHEREAS, the City Planning Commission did hold a public hearing in the City Hall in the City of Anaheim on Septembe r 16 , 1974 at 2; pp o'clock p.m., notice of said public hearing having been duly yven as required by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.64, to hear and consider evidence for and against said proposed conditional use and to investigate and make findings and recommendations in connectibn therewith; and WHEREAS, seid Commission; after due inspection, investigation, and study madc by itself and in its behalf, and ai'ter due consideration of all evidence ~~d reports offered at said hearing, does find and determine th: following (acts: 1. That the proposed use is properly one for which a Conditiona] Use Permit is authorized by Code Sec t i on 18.64.020(1)(e), to wit: establish a five-unit planned residential development to be use~ as a model home complex with sales office f~r one tentative tract with a total of 85 dwelling units, with waiver of: SECTION 18.62.075 - Maximum number of siqns. (4 temporary on-site signs permitted; ~ temporary oii-site signs proposed) 2. That the above-mentioned waiver is hereby granted on the basis that the tyoe, nature and locatiun of.said temporary signs would not be detrimental to the general area. 3, That t1:a proposed use will not adversely affect the adjoining land uses and tlie growth and development of the area in which it is pronosed to be located. 4, That the size and shape of Uie site proposed for thc use is adcquate to allow tLe full development of the p:oposed use in a manner not detrimental to thc particular area nor to the peace, liealth, safe'y, and genernl welfarc of thP Citizens of the City of Anaheim. r~, That the grantingof the Conditional Use Permit under the conditions imposcd, if any, will not be detriment~l to the peacc, healCh, safety, and general welfare of the Citizens of the City oS Anaheim. - 6. JIv 1699 . • ~ ~ ' NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Pianning Commission does hereby~ grant subject Petition for Conditional Use Permit, upon the following conditions which are hereby found to be a necessary prerequisite to the proposed use of the subject property in order to preserve the safety and general welfare of the Citizens of the City of Anaheim: l. That trash storage areas shall be provided in accordance with approved"plans on file with the Office of the Director of Public Works. 2. That fire hydrants shall be installed and charged as required and determined to be necessary by the Chief of the Fire Department pr~or to commencement of structural framing. 3. That subject Qroperty shall be served by underground utilities. 4. That drainage oT said property shall be disposed of in a manner satisfactory to the City Engineer. If, in the preparation of the site, sufficient grading is required to necessitate a grading permit, no work will be permitted between October 15th and April 15th unless all required off-site drainage facilities have been installed and are operative. Positive assurance shall be provided the City that such drainage Tacilities will be com- pleted prior to October 15th. Necessary right-of-way for off-site drainage facilities shall be dedicatea to the City, or the City Couneil shall have initiated condemnation pro- ceedings therefor ~the costs of which shall be borne by the developer) prior to the com- mencement of grading operations. The required drainage facilities shall be of a size and type sufficient to carry runoff waters originating from higher propertie=_ through said property to ultimate disposal as approved by :he City Engineer, Said drainage facilities shall be the first item of construction and shall be comaleted and be functional throughout the tract and from the downstream boundary of the property to the ultimate point of disposal prior to the issuance of any final building inspectinr,s or ~ccupancy permits. Drainage district reimburseir.ent agreements may be made availabie ir~ t'r~ cfevelopers of said property upon their request. 5, That grading, excavation, ancl all other construct%~m 3c;ivities shall be conducted in such a manne~ so as to minimize the possibility of' any si1L oriyinating from this project being carried into the Santa Ana River by storm water originating from or flowing through this project. 6. That public util~ty easements shall be gra~ted as.required by the Director of Public Utilities. 7. ?hat this conditional use permit shall remain in full force and effect until the Final Map ef Tract No. 8560, Revision 2, has been recorded and P~nal'reading of the: -. prdinance rezoning this pfoperty has been accomplished. 8. That the houses with this model area may not be sold or occupied until Final Map of Tract No. 8560, Revision 2, has been recorded and an ordinance has been read rezoning subject property. g. That a bond in an amount and form satisfactory to the City of Anaheim shall be posted with the City to guarantee the removal of the models in the event Final Map of Tract No. 8560, Revision 2, is not recorded, 10, That subject property shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim marked Exhibit Nos. 1 through 12. il. That Condltian Plos. 6 and 9, above-mentioned, shall be compiied with prior to the commencement of the activity authorized under this resolution, or prior to the time that the building permt is issued, or o~ithin a period of one year from date hereof, wPiichever occurs first, or such further time as the Planning CommisSion may grant. 17.. That Condition Nos. 1, 3, 4, 5 and 10, above-mentioned, shall be complied with p;•ior to final building and zoning inspectio~s.
