A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM
RECOMMENDING TO THE CITY COUNCIL OF THE CITY OF ANAHEIM THAT
PETITION FOR RECLASSIFICATION N0. 74-75-> > BE APPROVED
WHEREAS, the City Planning Commission of the City of Anaheim did receive a verified Petition for Reclessifica-
~nfrom ROY M. SHARP, 1235 South Magnolia Street, Anaheim, California g2$04 (Owner);
WILLIAM E. TACKABERY, 747 West Katella Avenue, #207, Oranga, CaTi`ornia 92667 (Agent);
of certain real property situated in the City of Anaheim, County of Orange, State of
California, described as The North half or the South 164.00 feet of the northeast quarter
oi the northeast quarter of the northeast quarter of Section 24, Township 4 South, Range 11
West, in the Rancho Los Coyotes, as per map recorded in Bo~k 51 Pz9e 11 of Miscellaneous
Ma,s, in the oifice of the County Recorder of said County, except the West 430.00 feet
thereo~,
Said la~d is included within the area shown on a map filed for record in Book 26 Page 4 of
record of surveys, in the office of the County Recorder.

WHEREAS, the City Plenning Commission did hold a public hearing at the City Hell in the City of Anaheim on

14HEREAS, said Commission, efter due inspection, investigation, and study made by itself end in its behelf, end
efter due consideration of all evidence end reports offered at seid hearing, does find end determine the following facts:
l: That the petitioner proposes a reclassificatioi or tfie atiove ile~cYibed property
from tFe"R~A'(AGRICULTURAL) ZONE to Ehe R-3 (MULTIPLE~FAMILY RESIDENTIAL) ZONE.
2. That the proposed reclassificztion is in conformance with the land use designation
on the Anaheim General Plan.
3. That the proposed ceclassifieetion of subject property is necessery and/or desireble for the orderly and pco-
per deve;opment oE the communit,y.
4. Thet the proposed reclesslEication of subject property does properly relate to the zones end their permitted
uses locally established in close proximity to cubject proQerty end to the zones end thelr permitted uses generally estab-
lished throughout the community.
5. That the proposed reclassification of s~!~Ject prope~ty requires the dedication and
improvement of abutting, s'treets/alieys in accordan~e with rhe Circulation Element of the
General Plan, due to the anticip~ted i~cPease in traffic which will be generated by the
intensi4lcation o` land use.
6. That no one appeared in opposition to subject petition.
ENVIRO~MEhTAL IMPACT REPORT FIND!NG:
That the Planning Commission recommends to the City Council that the subject project be
exempt trom the requiremerL to prepare an Environmental Impact Report pursuarit to the
provisions of the Californie cnvironmental Quality Act.

NOW, THEREFORE, BE IT RESOLVEu that the Anaheim City Planning Commission does hereby
recommend to the City Council of the City of A~aheim that subject Petition for Rer_lass-
i~ication be approv.>.d and, by so doing, that Title 18-Zoning of the Anaheim Municipal Code
be amended to exclude the. above descrihed property from the R-A, (AGRICULTURAL) ZONE and to
incorporate said desc~ibed oroperty into the P,-3 ("1UL?IPI.E-FP.MI!_`( RESIDEPITIAL) ZONE upon the
fol3owing conditions which are hereby found to be a necessary prereouisite to the proposed
= of subject property in order to preserve the safety and general welfa're of the Citize~s
;' tl~e City of Anaheim:
1. That the oNner(s) of subject property shall deed to the City of Anaheim a strip o`
lard 53 feet in width from the centeriine of the street along Magnolia Avenue for street
widening purposes.
2. That ail engineering requirements of the City of Anaheim along Magnoiia Averue, in-
cluding Fre}.aration or imFrovement plans and installation of all improvements such as cu;bs
ano g~~rCers, sYdewalks, street grading ard ;.aving, drainage facilities, or o~her a;~puc'ter.ar~t
~~ork shall be ccTpi~ed with as required by the City Enginees' and ir~ accordance with standard

3. ;hat the owner(s) af subject property shall pay to the City oF Anaheim the sum of
60C per rront r"oot along ~4agrolia Avenue for tree pianting purFoses.
4. That trash storage areas sFaii be provided in accordance with approved plars ors `iie
with the off~ce of the Girector of Public Works.
5. That rire hydrants shall be installed and charged as required and determined to be
neces<_ary by the Chief of the Fire Department prior to commencement or structural framing.
6. That all air-conditior,i~g facilities shall be properly shielded from view.
;, That subject property shall be served by undergrou~d utilities.
8. That a six-foet nasonry wall shall be constructed along the souih property line.
9, ?hat drainage o~ subjec: property shall be disposed of in a manner satisTactp~'y to

10. In the event that subject property is to be divided for the purpose of sale, laa::~
or rinancing, a~arcel map to record the approved division of subject p~ope:ty shal! be
subrnitted to and approved by the City of Anaheim and then be recorded in the o`fice of %:h~
Orange Cou~ty Recorder.
il. That the owner(s) or subject property shall pay to `,.he City o` Anaheim 'the aF,^.so-
priate park and recreation in-]ieu fees as determined to Ee aooropriate by the City Counc`1,
