HEMMERLING, in care of Jack Anderson, 2333 North Broa3way, Santa Ana, California 92706, Owner; S.E. SCHOLL, 15?4 Ganesh P1ACe, Pomona, California 91768, Agent oi- certain real property situated in the City of At:sheim, County of Orange, SCate of California described as The East half o£ the nort8east quant~he f' the northeast quarter of Section 17, Township 4 south, Range 10 west, oartly Rancho San Juan Cajon de Santa Ana, and partly in the Rancho Los Coyotes, as per map recorded in Book 51, Page 10 of Miscellaneous Maps, in the offir_z of the County Recor~9er of said co~nty. ~XCEPT from said east half the northerly 411.00 feet of the easterly 303.00 feet, as described in the lease to Big Boy, Euclid, Inc., recorded Aug~ist 13, 1968 in Book 8689 Page 869, of official records of said county. Thet the proposed use is properly one for which a Conditionel Use Permit is autharized by Code Section 18,64.020(3)(d) to wit: establish an automobile sales agency and service fscil~ty, with waivers of: SECTION 18.40.070(4)(a)2.f. a - Minimum number of off-street parking spaces. . PC74-2 . ~ ~ 2. That the petitioner stipulated to withdraka7, of Waivers 1-a, I-c, 1••e, 1-g end 1-h, above-mentioned. 3. That Wai~er 1-b, above-mentione3, is hereby granted on the basis that the size of the signs would cor.form to the maximum ~ermitted aggregate free-standing sign area, and that two of the free-standin~ signs were directionel and determined to be essential for the proposed use. 4. That Waivers i-c and 1-f, above-mentioned, are hereby granted on the basis that due to the width of the subject property, a hardship would be imposed which would prevent essertial signing for the pzoposed use. 5. That the petitioner stipulated to providing a 20-foot wide landscape strip along the entire westerly property line adjacent to residential uses. 6. That the petitioner stipulaited that the westerly portion of si~.bject property proposed to be paved would be used for sto•rage ~f ne•.: automobiles. 7. That the petitioner was present with counsel at said public hearing a:id rec- ~gnized that future hardships might be created by an overpass at Lincoln Avenue and Euclid Street, which has been under discussion by City officials and the California State Division of Highways, and that the petitioner requested that approval of ~he Con- ditional Use Permit be made subject to *_heir investigation and examination of any pro- posed plannin~ of the California State Division of tIighways for said overpass, which, if constzucted, miSh~necessitate changes to the submitted plans for devel.opmeat of subject property. . 8. That the proposed use, as granted, will not adversely affect the edjoining land uses and the growth and development of the area in which it is proposed to be located. 9. That the size and shape of the site proposed for the use, as granted, is ade- quate to allaw the full development of ttie proposed use in a manner not detrimental to the particular srea nor to the peace, health, safety, and general welfare of the Citizens of the City of Anaheim. 10. That the grant~ng of the Conditional Use Permit under the conditions imposed, if any and as granted, will not be c;etrimenCal to the peace, health, safety, and general welfare of the Citizens of the City of Anaheim. ENVIRONtdENTAL IMpACT RRPORT FIIJDING: That the Planning Commission, in connect3on with an ExempCion Declara~iun Status request, finds and determines that the proposal would have no significent environmental imp~ct and, therefore, recommends to the Ci.ty Council that no Environmental Impact StaCement is neces- sary. NOFI, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Cocmciission does hereby grant in part aubject Petition for Conditionel Use Permit, upon the following conditions which are hereby found to be a necessary prerequisite to the proposed use of the subject p^c~erty in order to preserve the safety and general welfare of the Citizens of the City nf Anaheim: (Y) ihat all engineering requiremenCs of the City of Anaheim, along Euclid Street including preparation of improvement plans and tnstallation of all improvements such as curbs and gutters, sidewaTks, streee.grading and paving, drainage faciiities, or other appurtenant work aha11 be complied with'las required by the City fingineer and in accordance with standard plans and specifications oe f~~le in the offi.ce of the City Engineer; Chat a bond in an amount and-form satis£actory to the City of Anaheim shall be posted wiCh the City to gnarantee the installation of the above-mentioned requirementa. (2) That the ovmer(a) of subject property shall pay to the City of Anaheim the sum of 60..cents per front foot along ~uclid Street for tree planting purposes. (3) Th~t appropriate water assessment fees as deCernined by the Directox• oi Public Utilities shall be peid tu the City of Anaheim prior to the issuance of a building permit. (4) That all air condi,tioning facilities shall be properly shielded from view, and the s~und buffered from adjacent properties. (5) That subject property shall be developed substantially in accordan:.e Wi*end15ng and specifications on file with the City of Anaheim marked Exhibit Nos. 1, 2, 3, 4 , with the additionaY provision that a 20-foor. wide landscape strip shall be provided along the entire westerly property line, as stipulated to by the petitioner. ~2 RESO;.UTION N0.
