P~74'202 _ A RESOLUTION OF THE CITY PLANNVNG COMMISSION Or THE CITY OF ANAIiE1M THAT PETITION FOR VARIANCE NO. 2635 BG GRANTED I N PART WHEREAS, the City Planning Commission of the City of Anaheim did receive a verified Petition for Variance from BRIGHAPI YOUNG UNIVERSITY, 50 East South Temple, Salt Lake City, Utah, 84111 (Owner); MATREYEK HOMES, INC., P. 0. Box 711, Uplancl, California 91786 (Aaent)• of certain real property situated in the City of Anaheim, Coun*yo uf Orange, State of California, as described in Exhibit "A" attached hereto and referred to herein as though set forth in full; and WHF.P.EAS, the City Planning Commission did hold a public hearing at the City Hall in thc City of Anaheim on October 14, 1974, at 2:00 o'clock p.m., notice of said public hearing having been duly siven as required hy law and in accordance with the provisions of the Maheim Municipal Code, Chapter 18.68, to hear and consider evidence for and against said proposed variattce and to investigate and make findings and recommendations in connection therewitli; and WHEREAS, said Commission, ~fter due inspection, investigation, and study made by itsclC und in its bchalf, and after duc consideration of all evidence and reports ofCered at said hcaring, does find and determinc thc following tacts: 1. Thatthepetitionerrequests the fol lowing variance from the Anaheim Municipal Code, to construct a 326-unit, four-tract subdivision, with a theme tower and two free-standing signs; a. SECTION 18.08.440 - Required lot fronta4e on a public street. (Il lots with . no frontage on a public street proposed) b. SECTION 18.28.050(51~a) - Maximum sEructural heiqht. (2 stories or 35 feet permitted; 0 feet proposed) c. SECTION 18.62.05~~c) -"Maximum siqn area. (20 sq. ft. permitted; ~ sq. ft, proposed) d. SECTION 18.62.145 - Prohibited signs. (Banners not permitted) 2. That Waiver 1-a, above-mentioned, is hereby gra~ted on the basis that four (4) of said lots would be used fcr recreational purposes and the remainder for residential uses consisting of 108 condominium units, and that similar waivers have been previously approved by the Commission to allow for development of the small lot condominium concept. 3. That lJaiver 1-b, above-mentioned, is hereby granted on the basis that the proposed structural height is 61 feet and'would house a master television antenna system for the entire planned community, said he;ight being necessary to provide quality television recep- tion and eliminating the need for individual television antennas throughout the planned community. 4. That Waivers 1-c and I-d were elim~nated by the submittal of revised plans and were therefore withdrawn by the petitioner. 5. That there are exceptiona! ur extraordinary circunistances or conditions applicable to the property involved or to the intended use, as granted, of the property that do not apply generally to the property or class of use in the same vicinity and zone. 6. That the requested variance, as granted, is necessary for the preservation and enjoyment of a substantial property right possessed by other property in the same vicinity a~d zone, and denied to the properYy in question. 7. That no one indicate~their presence at said public h~earing in opposition to subject petition, and no correspondence was received in opposition. ENVIRONI4ENTAL IMPACT REPURT FINDING: That Environmental Impact Report Nos. 134 and 135, supplementing master Eir No. 113, having been considered this ~ate by the Planning Commission and evidence, both written and oral liaving been presented to supplement said draft EIR Nos. 134 and 136, the City Planning Commission believes that said draft E!R Nos. 134 and 136 do conform to the City and State Guidelines and the State of California Environmental Q~ality Act and, based upon such information, does hereby recommend to the City Louncil that they certify said EIR Nos. 134 and 136 are in compliance with said Environmental Quality Act; provided; however, that Paragraph 4 of Page 7 of F.IR No. 136 shall reflect that the depth of the lake shall be no more than one foot (1 ft.) at the shoreline and shall slope to a maximum of three feet (3 ft.) at a distance of twelve feet (12 ft.) from shore, being a 4:1 slope, as stipulated to by the petitioner. NOi~I, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does hereby grant in part subject Petition for Variance, upon the following conditions ~•~hich are hereby found to ,~e a necessary prerequisite to the proposed use of the subJect propert'y in order to pre:;erve the saFety and general welfare of the Citizens of the City of Anaheim: l. That this variance is granted subject to the completion of Reclassification No. 73-74-36, now.pending. , 2. That subject property shall be developed substantially in accordance with plans and specifications on file ~•iith the CiCy of Anaheim marked Exhibit Nos. l, 2 and 3(Revision No, 1), and 4 through 14.
