A RESOLUTION OF THE CITY PLANNING COMM SSION OF THE CITY OF ANAHEIM
THAT PETITION FOR VARIANCE NO. 2~39 BE GRANTED
WHEt~.EAS, the City Planning Commission of the City of Anaheim did receive a verified Petition for Variance
from WILLIAPI F. DARLIN, 325 North West Street, Anaheiro, Califotrnia 92801 (O~+ner) of certain
real property situated in the City oF Anaheim, County of Orange, State of Caltfornia,
described as Lot 5 of Tract No. 2381, as pey map recorded in book 69 pages 15, 16 and 17
of Misr.ellaneous Maps, in the office of the county recorder of said county
; and
WHEREAS, the City Plauning Commission did hold a public hearing at the City Hall in the City of Anaheim
on October 14, 19]4, at 2:00 o'clock P.M., notice of said public hearing having been duly given as required
by law and in accordance with the provisions of the Anaheim 17unicipa! Code, ChapEer 18.68,to hear and consider evi-
dence for end against said proposed vc~riance and to investigate and make findings eud recommendetions in connection
therewith; and
WH~:kEAS, said Commission, aEter due inspection, investigation, and study made by itself and in its behalf,
and efter due consideration of all evidence and reports offered at said heacing, does find end determine the fcllowing
facts:
1. Thatthepetitionerrequests the following variance from thE Anaheim Municipal Lode, to
construct a free-standing siyn in the C-0 Zone:

Zone)
2. That the petitioner stipulated to removing the existing free-standing 5ign at the
subject iocation.
3, That thece nre exceptional or extraor~inary circumstences or condit:ons applicable to the pmperty involved
or to the intended use of the property tliat do not apply generally to the Qroperty or class of use in the same vicinity end
zone.
4, That the requested variance is necessary for the preservation.and enioy-nent of a subs4antial propecty right
possessed hy other property in the same vicinity and zone, snd denied to the propecty in question.
S. That the requested vaciance will not be mat;;ri~lly detrimental to the public welfare or injurious to tha prop-
erty or improvements in such vicinity and zone in which th~ property is located.
6. That no one indicated their [.r~osence a~ said public hearing in opposiYion to subject
petition, and no correspondence was received in opposition,
ENVIRONMENI'AL IMPACT REPORT FINOIN6:
That the Director oF Developrnent Services has determined that the proposed activity Talls
within the definitior oF Section 3.01, Class il of the City of Anaheim Guidelines to the
Requirements Tor an Environmental Impact Report and is, therefore, categorically exempt
from the requirement to file an EIR.

NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does heceby grant subject
Petition for Variance, upon the following conditions which are hereby found to be a necessary pcerequisite to the pro-
posed use of the subject property in ocder to preserve the sefety and genecel welfare of the Citizens of the City of
Anaheim:
i. That the owner(s) oT subject property shall pay'tot~e City of Anaheim the sum of
$2.00 per front foot along Euclid Street for stre~t lightir.g purposes.
2. That the owner(sl of subject property shali pay to the City of Anaheim the sum of
60t per front foot along Euclid Street for tree planting purposes.
3, That subject property shall be developed substantially in accordance with plans
and specifications on file with the Ci*_•! of Anaheim marked Exhibit Nos. l, 2 and 3•
