PC7~+-2Q5 ~ A RESOLUTION OF TNE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM THAT PETITION FOR VARIANCE N0. 2642 BE DENIED WHEREAS, the Citv Planning Commission of the City of Anaheim did receive a verified Petitioa for Variance from RICHARD BENTLEY, 1425 East Lincoln Avenue, Anaheim, California 92805 (Owner); COUNTY OF ORANGE; DEPARTMENT OF REAL PR01'ERTY S&RVICES, 400 Civic Center Drive West, Santa Ana, California 92701 (Agent); of certain real property situated in the City+•of Anaheim, County of Orange, State of California, described as Lot Nos. 3 and 4 of Tract No. 2481 as per map recorded in book 72.page Zy cf Miscellaneous Maps, in the office of the county recorder of said county; and WHEREAS, thc City Planning Commission did hold a public hearing at the City Hall in the City of Analteim on Octobe r 14, 1974, at 2:00 o'clock p.m., notice of said public hearing having been duly given as required by law and in accordance with the provisions of the Mlheim Municipal Code, Chapter 18.68, to hear and consid~:r evidence for and uguinst said proposed variance and to investigate and make findings and recommandations in connection therewith; and WHEREAS, said Commission, after due inspection, investigation, and study made by itse:f and in its behalf, and after due consideration of all evidence and reports offered at said hearing, does find and determine the following facts: 1. (54 spaces required; ~6 spaces existing) 2. That the above-mentioned waiver is hereby denied on the basis that evidence was . presented that substantiated a currenf parking shortage at the subject location for the existing uses, and the propo;al would further compound thet situation. 3. That the Planning Commission indicated thair suppor.t of locating the Methadone Maintenance Treatment Program Medical Clinic in the City of Anaheim, but indicated that it should be located further from a public scltool than proposed ir, subject petition, since thc vehicular traffic generated by such a ase was not conducive to the safety and welfare of school children. 4. That there are no exceptional or extraordinary circumstances or conditions appli- cable to the property involved or to the intended use of the property that do not apply generally to the ppoperty or class of use in the same vicinity and zone. 5. That the requested variance is not necessary °or the preservation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone, and denied to the property in question. 6. That the requested variance will be materially detrin~ental to the p~blic welfare or injurious to the property or improvements in such vicinity and zon? in wh~ch the property is located. 7. That two (2) persons appeared, representing approximat'ely twelve (12) persons present at ssid public hearing in opposition to subject petition; that two (2) letters were received in opposition to subject petition; a~d that petitions containing approximately 114 signatures were received in opposition to subject petition. NOW, THEREFORE, BE IT RESOLVED that the Maheim City Planning Commission does hereby deny subject Petition for Variance on the basis of the aforementioned finds.
