RESOLUTION~ PC?'~-~~9 ~ A KESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM RECO114MENDING TO THE CYTY COUNCIL OF THE CITY OF ANAHEItd THAT PETITION FOR RECLASSIFICATION NO. ~4'75-16 gEAPPROVED IN PART WHEl2EAS, the City Planning Commission oE the City of Maheim did ceceive a verified Petition for Re- clessification from SHOICHI ICUBO, 721 South Beach Boulevard, Anaheim, Cal ifornia 92804 (Owner) ; OSTRANDER AND KISHIYAMA, 2212 DuPont Drive, Suite F, Irvine, California 92664 (Agent) of certain real property situated in the City of 1lnaheim, County of Orange, State of California, as described in Exhibit "A" attached hereto and referred to herein as though set forth in full ; end WHEREAS, the ~^.ity Plenning Commission did hold e public hearing at the City Hall in the City of Anaheim on Octobel' j0,1974 at 2:00 o'clock P.M. notice of seid public hearing having been duly given as required by law and in accordence with the provisions of the Anaheim Mmiicipal Code, Chaptar 18.72, to hear and consider evidence for and against seid proposed reclassiEication end to investigate ertdmake~ findings andrecommendetions in connection therewith; and WHES2EAS, seid Commission, after due inspection, investigation, and study mede by itself and in its be- half, end after due consideration of all evidence and ceports oftered et said heering, does find and determine the tollowing facts: 1. That the petitioner proposes e reclassification of subject Groperty from the R-H (AGR I CULTURAL) ZON~ TO THE C-1 (GENERAL COMMERCIAL) ZONE. 2. That tlie petitioner s*_ipulated that the westerly approximately 220-foot portion of the property originally included in the rezoning request would be excluded from this reclassification since said westerly portion could become isolated by the future eatension of Hayward Street and development of said westerly portion is not proposed at this time. 3. That the petitioner stipulated to removal of the existing dwelling which, in its present location, would obstruct the future extension of Hayward Street, said removal to take place when requested to do so by the City. 4. That the Anaheim General Plan designates 5ubject property for general commercial and/or medium-density residential uses. 5. That the proposed reclassification of subject property as granted is necessary and/or desirable for the orderly and proper developmznt of the community. 6. That the pro~ased reclassification o` sub;ect property as granted does properly relake to the zones and their permitted uses locally established in close proximity to subject property and to the zones and their permitted uses generally established throughout the commu~ity. 7. That the proposed reclassification oP subject property as yranted requires the dedic_~Lion and improvement of abutting streets in accordance with the Circulation Element of the ~enereil Plan, due to the anticipated increase in traffic which will be generated by the intensification of land use, 8. That no one indicated their p!'esence at said public hearing in opposition and no correspondence was received in opposition to subject petition. U~.~Ch tlL'IJ.. ..{ }~rJ`,~ '''~!` ~(~-~J ~~~0 _ _ __. . ~ i ~ v. .......r ~• ^ NOW, THEREFURE, BE IT ~LVED that the Araheim City P1alWing Commission does hereby recommend to the City Council or the City oP Araheim that subject Petition for Reclassification be approved and, by:o do~~g, tnat Title 18-Zoning of the Anaheim Municipal Cude be amended to exc~ude the above-described proper•ty from the R-A (AGRICULTURAL) ZONE and to incorporate said de~::ribed property iRto the C-1 (GENERAL COt1MERCIAL) ZONE, upon the following conditions which a;e hereby found to be a necessary prerequisite to the proposed use of subject property in order to preserve the saf~ty and general welfare of the Citizens of the City of Anaheim: 1. That the owner(s) of subject property shall conditionally dedicate to the City of Anahei~ a strip of land 3Z feet in width from the centerline of the screet along Nayward Street for stree± wiueni~g purposes, conditiored upon need for the street and demand by the Ci:y; and that the owner(s) shall remove the sxisting dwelling which, in its present location, would obstruct the future extension of Hayward StreeY, said removal being conditioned upon nsed for the street and demand by the City, as stipulated to by the petitioner. 2. That sidewalks shall be i~stalled along Beach Boulevard as required by the City Engineer and in accordance with standard pians and specifications on file in the office of the City Engineer. 3, That street lighting facilities along Beach Boulevard shall be installed as re- quired by the Director of Public Utilities and in accordance with standard plans and specifications on file in Lhe Office of the Director of Public Utilities; and that a bond in ar. amount a~d form satisfactory to the City oF Anaheim shall be posted with the City to guaran- tee the installation of the above-ment•ioned rPy~irements. 4. That the owner(s) of subject property shall pay to the City of Jlnaheim the sunt of 60t per front foot along Beach Boulevard for tree plar.ting purposes. 5. That trash storage areas shall be provided in accordance with approved plans on file with the office of the Director of Public Works. 6. That fire hydrants shall be installed and charged as required and determined to be r.ecessary by the Chief oT the Fire Department prior to commencement of structural framing. 7. That drainage of subject property shall be disposed of in a manner s~tisfactory to the City Engineer. 8. That app!opriate water assessment fees as determined by the Director of Public U~ili*.ies shall be paid to the City of Anaheim prior to the issuance of a building permit. '9. That a parcel map to record the approved division of subject ~roperty shall be ::~bm~:`_ed t~ and approved by the City of Anaheim ard then be recorded in the office of the ~Ora~ga County Recorder. 10. Prior to the introduction of an ordinance rezoniny subject propert)~, Condition Nos. 1, 3, 4 ar.d 9, above-me~t~oned, shall be completed. The provisions or rights granLed by thi~ resolution shall become null and void by action of the City Council unless said conditio^s are complied wi*_h within one year from the date hereof, or such further time as the City Council may grant. Il. That Cor,ditio~ Nos. 2, 5 and 7, above-mentioned, shall be complied with prior to final building and zoning inspections.
