PC74-210 A RESOLUTION OF TEIE CITY PLANNING COMMISSION OF TEIE CITY OF ANAHEIM THAT PETITI;)N FOR CONDITIONAL USE PERh11T ~~8 BE GRANTED WHEREAS, the City Planning Commiss9on oE the City oE Anaheim did receive a vecified Petition for Con- ditionalUsePermitfrom SHOICHI hUBO, ;21 South Beach Boulevard, Anaheim, California 92804 (Owner)• OSTRANDER AND KISHIYAMA, 2212 DuPont Drive, Suite F, Irvine, California 92664 (Agents) of certain real property situated in the City of Anaheim; County of Urange, StaCe of California, as described in Exhibit "!' attached hereto and referred to herein as though set forth in full . ; and WHEREAS, the City Planning Commissian did hold a public heaiing. at the City Hall in the City of Anaheim on October 3~ ~ 197~+~ at 2:00 o'clock P.M11., notice of said public heering having been duly given as required by law and in accordance with the provisions of the Anaheim Municipal code, Chapter 18.64, to hear • and consider evidence for and against said proposed conditional use nnd to investigate and make Eindings and recommendations in connection therewith; and - WHERLAS, said Comr~ission, after due inspection, investigation, and study made by itself and in its be- half, and after due consideration of all evidence and reports offered at said hearing, does find and deiermine the ~ following facts: ~ 1. Thnt the p:oposed use is properly one for which a Conditi:!>,~al Use Permit is authorized by Code Sect i on 18.40.06U(h), to wit: permit the continued use and expansion of an existing plant nursery, with waivers of: , a. SECTION 18.40.0%0(2)(a)6 - Permitted drivewa~v~idth. ( 0 feet permitted; ~'S feet existing) b. SECTION 18.40.070(3)(a) - Maximum buildinq height. (6 feet required; 10 feet . existing) ~ c. SECTION 18.40.070(6)(a) - Required block wall adlacent to R-A zoning. (6- foot wall required; none proposed) 2. That Waivers 1-a and 1-b, above-mentioned, are hereby grdnled on the basis that the drive~aay and building are existing and do not interfere with the neighboring area. 3. That Waiver 1-c, above-mentioned, is hereby granted on the basis,that the adjacent F-A zoned properties are developed oiith a basebail range and vacant. 4. That the proposed use ~rill not adversely affect the adjoinina land uses and the growth and development of the area in which •it is proposed to be located. 5. That the size and shape of the above-described site for the proposed use is adequate to allow full development of the propa~ed u5e in a manner not detrimentel to the particular area nor to the peace, health, safety, and general welfare of the Citizens of the City of Anaheim. • 6, That the gran~ing of the Conditional Use Permit under the conditions imposed, if any, will not be detrimental to the peace, health, safety, and gener~'; welfare of the Citizens of lhe City of Anaheim. ' 7. That no one indicated their presence at said public hearing in oppo~ition; and no correspondence was received in opposition to subject petition. That this Conditional Use Permit is cranted subject to the completion of Reclassification No. 74-75-16, now pending. 2.
