THAT PETI'TION FOR VARIANCE N0. 26~+3 BE GRANTED
\VHEREAS, the City Planning Commission of the City of Anaheim did receive a verified Petition for Variance Gom
TIMOTHY W. WALLACE, c/o Leonard Smith Real Estate, 125-D South Claudina Street, Anaheim,
California 92805:(Own.er)i LEONARD SMITH; 125-D South Claudina Street, Anaheim, California
g2805 (Agent) of certain real property situated in the City of Anaheim, County of Orange,
State of California, as•~de~cr,.i~b~u in Exhibit "A~' attached hereto and referred to herein
as though set forth in full; and
WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim on
Octobe r 30 , 1974, at 2:00 o'clock p.m., notice of said public hexring having becn duly ~iven as required by law and
in accordance with the provisions of the Mahaim Municipal Code, Chapter 18.65, to hear and consider evidence fot and against said
proposed variance and to investigate and make findings and recommendations in connection therewith; and
WI;EREAS, said Commission, after due inspection, investigation, and study made by itselC and in its bchalf, and after due
consideration of all evidence and reports oCfered at said hearing, does find and determine the following facts:
1. Thatthepetitionerrequests the fol lowing variance~,s, from •the Anaheim Municipal Code, to
establish the outdoor storage of used automobile supplies and parts:
a. SECTION 18.44.010 - Permitted uses. (Outdoor storage not permitted)
b. SECTION 18.44.030(5)(a)(1) - Minimum off-street parking. (66-2/3% of lot area
required; none proposed)
2. That Waiver 1-a, above-mentioned, is hereby granted for a period of two (2) years,
subject to review and consideration for extension of time by the Planning Commission and/or
City Council upon request by the petiYioner.
3. That Waiver 1-b, above-mentioned, is hereby granted on the basis that the proposed
off-street parking is adequate for the subject use, since the petitioner stipulated that
there would be no walk-in retail sales, and that no sales persom,el would be available at
the subjecr. location.
4. That the petitioner stipulated that all outdoor storage would be below the height
of the six-foot (6-ft.) fence, and not visible from the exterior of subject property.
5. That there are exceptional or extraordinary circumstances or conditions applicable
to the proFzr~y involvEd or to the intended use of the property, as granted, that do not
apply gene~ally to Yhe property or class of use in the same vicinity and zone.
6. That the requested variance, as granted, is necessary for the preservation and en-
joyment of a substantial property right possessed by other property in the same vicinity and
zone, and denied to the property in question.
7. That the requested variance, as granted, wili not be materially detrimental to the
public welfare or injurious to the property or improvements in such vicinity and zone in
which the prcperty is located.
8. That no one indicated their presence at said public hearing ;~ opposition, and no
correspondence was received in oppasition to subject petition.
ENVIRONMENTAL IMPACT REPORT FINDING:
That the Planning Commission recommer.ds to the City Council that the subject project be
exempt from the requirement to prepare an Environmental ImpacC Report, pursuant to the
provisions of the California Environmental Quality Act.

R , NOW, THEREFORE, BE I~ESOLVED that the Anaheim City ~anning Commission does hereby
grant subject petition fo'ri.Var.i~nce, upon-:the:fol~lowi~ng~•canditions~which~~are~he'reby
found to be a necessary prerequisite to the proposed use of the subject property in order
:o preserve the safety and general welfare of the Citizens of the City of Anaheim:
1. That siclewalks shall be installed along Manchester Avenue as required by the
City Engineer and in aGCOrdance with standard plans and specifications on file in the office
of the City Engineer.
2. That the owner(s) of subject property shall pay to the City of Anaheim the sum of
60C j:~r front foot along Manchester Avenue for tree planting purposes.
3. That the owner(s) of subject property shall pay tn+'the City of Anaheim the sum
of $2.00 per front foot along Manchester Avenue and Center Street for street lighting
purposes,
4. That Lrash storage areas shall be provided in accordance with approved plans on
file with the office of the Director of Public Works.
5. That subject property shall be developed substantially in accordance with plans
and specifications on file with the City of Anaheim marked Exhibit Nos. 1 and 2.
6. That Condition Nos. 1 through 5, above-mentioned, shall be complied with within
a period of six months from date hereof or such `urCher time as the Planning Commission
may grant.
7. That this Variance is granted for a period of two (2) years, subject to review
and ~onsideration for extension of time by the Planning Commission and/or ~ity Council, upon
request by the petitioner.
8. That all outdoor storage shall be belo~~i the height of the six-foot (5 ft.)
ferce, as stipulated to by the petitioner.
9. That there shall be no walk-in retail sales conducted and no sales personnef
shall be evailable, at the subject location.
