PC74-215 A RESOLUTION OF THE CITY FLANNING COMMISSION (iF THE CITY OF ANAHEIM THAT P}:TITION FOR VARIANCE NO. 26~ BE GRANTED WHEREAS, the City Plenning Commission oE the City of Aneheim did receive a verified Petition for Veriance f:om DOCTOR AND MRS. JOHN S, ENGLISH, 1945 West Chanticleer Road, Anaheim, California 92804 (Owner); FORCIER CONSTRUCTION COMPANY, Attn: Sal Meraz, 4103 East Century Drive, Orange, California 92669 (Agent); of certain real property situated in the City of A~aheim, County or Orange, State of California, described as Lot 31 of Tract No. 3882~ as shown on a map recorded in book 144 pages 26, 27 and 28 of Misr.ellaneous Maps, in the office of the county recorder of said county, described as follows: Begin~ing at the northeast corner of said lot; thence South On 40' S8" East 132.30 feet along the East line of said lot and its southerly prolongation to the centerline of Cha~tir_leer Road as shown o~ said tract map; thence South 89~ ~9' ~Z" West 70.5~ feet aio~g said centerline to the southerly prolongation of the West line of said lot; thence North 0° 40' Sa" West 132.30 feet alon~ said prolongation and said West line to the northwest corner of said lot; thence North 89 19' 02" East 70.50 feet along the North line of said lot to the poin: of beginnirg ; and IVHEREAS, the City Planning Comnission did hold a public hearing at the City Hell in the City of Anaheim on October j0, 1974, et 2:00 o'clock P.M., notir.e of said public hearing having been duly given es cequired by law and in accordance with the provisions oE the Meheim Municipal Code, Chuptec 18.68, to hear end consider evi- dence for and egainst said proposed variance and to investigete and meke Eindings and rernmmendotions in connection therewith; nnd WHEREAS, said Commission, efter due inspection, investigation, and study made by itself end in its behali, and aEter due consideration of all evidence and reports oEfere3 at said hearing, does [ind end detecmine the following facts: 1. Thatthepetitionerrequests the following variances from the Anaheim Municipal Code, to construct a hause addition; a. SECTION 18.04.090~1~c) - Maximum eave projectiun. (20 inches permitted; ~0 inches proposed) b. SECTION i8.24,0~~b) - Ninimum rear Yard. (10 feet required; 6 feet proposed) 2. ENVIRONMENTAL IMPACT REPORT FINDING: That the Director of Development Services has determi~ed that the proposed activity falls withir the definition of Section 3.~1, Class 3 of the Gity of Anaheim Guidelines to the Requirements for an Environmental Impact Report and is, therefore, categorically exempt from the requirements to file an EIR.
