RESOLUTION II~- PC74-22 ~ A RESOLUTION OF THE CITY PLANNING COMMISSION OF TIiE CITY OF ANAHEIM THAT PETITION FOR CONDITIONAL USE PERMIT~--BE GRANTED WHEREAS, the Ci!y Plenning Commission of the City of Anehe;m did r~ceive a verified Petition Ear Con- ditional Use Pecmit fiom LEONARD G, SMITH, TRUSTEE, 125-D South Claudina Street, Anaheim, California 42805, Owner of certain real property situated in the City of Anaheim, County of Orange, State of California, desc:3bed as Lot Nos,. 17 and 18 of the.Konig Subdivision ; end WHEREAS, the City Plenning Commissiou did hold a public hearing at the City liall in the City of Aneheim on JBnuary 21, 1974, at 7:30 o'clock P.M., notice of said public hearing heving been duly given as ceqitiied by:law and in eccordence :~ith the provisions of the Maheim Municipal code, Chepter 18.64,to heer and consider evidence for and against said proposed conditional use end to investigete end meke Eindings and recommendations in connection therewith; end WHEREAS, said Commission, efter due inspection, investigation, and study mede by itself and in its be- half, and after ilue consideration of ell evidence and repocts offered at said hearing, does find and determine the following fects: 1. Thet the pcoposed use is properly one for which a Conditional Use Permit is aethorized by Code Section 18.52.050(1)(a), to wit: estsblish an ouCdoor recreational vehicle s~orage yard, with waivers of: ~ a. SECTIONr18.52.060(3)(a) - Screening adiacent to residential zone. (6-foot high enclosure required; no enclosure and 6-foot high chainlink fence nroposed) b. SECTION 18.52.060(3)(U; - Enclosure of outdoor uses, (6-foot high en- closure required; 6-foot high chainlink fence propoaed) c, SECTION 1£3.52.060 4 b - Off-street perking. (6 parking spaces required; 0 parkinq epaces proposed) d. SECTION 18.62.090B(5) - Permitted free-standing eign location. (Mini- mum 39 feet L-rom north property line required; 32 feet proposed) 2. That Waivers 1-a and 1-b, above-mentioned, are hereby granted on the basis that the petitioner demonstrated that a hardship relating to adequate`police protection for the proposed use would 3E created if view-screening was provided; and, further, that the sub- ject property is located in s transitional area. r 3. That Waiver i-c, above-mentioned, is here'r,y granted on the basis that the proposr.d . use would not require off-street customer parking and said use would be within the intent of the original M-1 Deed Restrictions for eubject prcperty. 4. That Waiver 1-d, above-menticned, ic hereby granted on the basis that the peti- tioner demonstrated a hardship would be created if said waiver was not granted, based on the plans, as aubmitted. -1- RESOLUTION N0. That the petitioner stipulated to erecting a chainlink fence along the northerly side of subject property abutting the R-3 parcel, in the event the existing building lo- cated on the adjacent R-3 parcel and on said properCy 'line is demolished. 6. That ~.".e proposed use will not adversely affect the adjoining land uses and the growth and development of the area in which it is proposed to be located. 7. ~hat the size and ~hape of the site proposed for the use is adequate to allow the full development of the ~roposed use in a manner not detrimental to the particular area nor to the peace, health, safety, and general welfare oE the Citizens of the City of Anaheim, 8. That the granting of the Condittonal Use Permit under the cot~ditions imposted, if any, will not be detrimental io the peace, health, safety, and general welfare of the Citi- zens of the City of Anaheim. 9. That une person appeared at said public hearing in opposition to subject petition. ENVIRONPSENTAL IMPACT. REPORi FINDINC~; That th~ Planning Coc~anission, in connection with an Er.emption Declaration SCatus request, finds and determines that the proposal would have no significant environmentai impact and, therefore, recommends to tne City Gouncil that no Environmental Impact Statement is aec2s- sary. NOW, THEREFORE, BE IT R~SOLVED that the Anaheim City Planning Commission does hereby grant subject Petition for Conditional Use Permit, upon the following conditions which are hereby found to be a r.ecessary prerequisite to the proposed use of the subject proFerl'y in order to preserve the safety and general welfare of the Citizens of the City of A~naheim: (1) That the owner(s) of subject property shall deed to the City of Anaheim a strip of land 10 feet in width from the centerline of the alley along the south side of subject property for alley widening purposes, (2) That sidewalks bhall be installed along Claudina Street as required by the City ~ngineer and in accordance with standard plans and specifications on file in the office of the City Engineer. (3) That trash storage areas Rhall be provided in accordance ~!ith approved plans on file with the office of the Director of Public Works, (4) That sub~ect property shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim marked Exhiliit No. 1. (5) That Condition No. 1, above-mentioned, shall be complied with prior to the com- mencement of the activity authorized under this resolution, or prior to the ti.me that the building permit is issued, or within a period of one year from date hereof, whichever occurs first, or such further time as the Planning Commission may grant. (6) That Condition Nos. 2, 3 and 4, above-mentioned, shall be compiied with prior to final building and zoning inspections.
