PC74-227 A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM RECOMMENDING TO THE CITY COUNCIL OF THE CITY OF ANAHEIM THAT PETITION FOR RECLASSIFICATION NO. ~'+'75' ~ 5 BE APPROVED WHEREAS, the City Planning Commission of the City of Anaheim did receive a verified Petition for Reclassifice- tionfrom JOSEPH A. MARTINEZ, 815 East Barkley Avenue, Orange, California 92667 (Owner) of certain real property situated in thu City of Anaheim, County of Orange, State'of California, described as Beginning at: a point on ~he South line of the LJest half of the Southeast quarter of the Southeast quarter of Section 15, in Townsh'ip 4 South, Range ll West, in the Rancho Los Coyotes, City of Anaheim, as shown on a map thereof recorded in book 51, page 11, Miscellaneous Maps, records of said Orange County, 378,5~ feet West of the Southeast corner thereof and running Chence West 82.69 feet along the South line of said West half; thence North parallel to the West line of the said West half 535.72 feet to a point on the Southerly line of the right of way of the Pacific Electric Railroad; thence Southeasterly along said right of way line 103.16 `eet; thence South parallel to the West line of the said West Fialf 473.60 feet to the point of beginning ; end WHEREAS, the City Plenning Commission did hold a public hearing et the City Hall in the City of Anaheim on November 2S, 1974, at 2:00 o'clock P.M. notice of seid publEc hearing heving been duly given es required by law and in eccordence with the provisions of the Aneheim ;Nunicipel Cade, Chepter 18.72, to heat and consider evidence for and against said proposed reclassificetion end to investigate end meke findings end recommendations in connection therewith; nnd WHEREAS, said Ccmmission, efter due Inspection, investigation, end study :nede by itself end in its behelf, end efter due cansideration of all evide~tce and reports offered et said heering, does Eind end determine the (ollowing facts: 1. That the petitioner proposes e reclessificetion of the ayove described prop'erty from the C-1 (GENERAL COMMERCIAL) ZONE to the R-3 (MULTIPLE-FAMILY) ZONE. 2. That the Anaheim General Plan designates subject property for medium-density residential and general comm~rcial uses. 3. That the proposed reclassificetion of subject property is necessery and/or desireble forthe orderly and pro- per development oE the community. 4. Thet the proposed reclessificetion of subject property does properly relete to the zones end their permitted uses locelly estebliehed in close proximity to subJect property and to the zones and their permitted uses generelly estab- lished throughout the community. 5. That the proposed reclassification of subject property requires the dedication and/ or improvement of abutting streets in accordance with the Circulation Element of the General Plan, due to the anticipated increase in traffic which will be generatad by the intensification of land use. 6, That two (2) persons indicated their presence at said public hearing in opposition, and no correspondence was received in opposi:ion to subject petition. ENVIRONMENTAL IMPACT REPORT FINDING: That the Planning Commission recommends to the Ci*_y Council that the subject project be exempt from the requirement to prepare an Environmental Impact Report pursuant to the provisions of the California Environmental Q~ality Act. PC74-227 oev-ce•r+ NOW, THEkEFURE, BE I~SOLVED that the Anaheim City ~ning Commission does hereby recommend to the City Council of the City of anaheim that subject Petition for Reclass- ification be approved and, by so doing, that Title 18-Zoning of the Anaheim Municipal Code be amended to e~aclude the above-described property From the C-1 (GENERAL COMMERCIAL) ZONE and to incorporate said described property into [he R-3 (MULTIPLE-FAMILY) ZONE, upon the following conditions which are hereby found t~o be a necessary prerequisite to the proposed use of subject property in order to preserve the safety and general welfare of the Citizens of the City of Anaheim: l. That all engineering requirements of the City o` Anaheim along Ball Road, including preparation of improvement pians and installaYion of all improvements such as curbs and gutters, sidewalks, street ~rading and paving, drainage facilities, or other appurtenant work shall be complied with as required ~y the City Engineer and in accordance with standard plans and specifications on fide in the office of the Ci*_y'cngineer; that street lighting facilities along Bal1 Road shall be installed as required by the Director of Public Utilities and in accordance with stt~ndard plans and speci`ications on file in the office of the Director of Public UYilities; and that a bond in an emount and form satis- factory to the City of Anaheim shall be nnsted with the City to guarantee the installation of the above-mentioned requi'remenrs. 2, That the owner(s) of subject property shall pay to the City of Anaheim the sum of 60C per front foot along Ball Road for tree planting purposes. 3. That trash storage areas shall be provided in accordence with approved plans on file with the office of the Director of Public Works. 4, That fire hydrants shall be installed and charged as required and determined to be necessary by the Chief of the Fire Department prior to commencemnt of structural framing. 5, That ~ubject property shall be served 6y underground utilit~es. 6, That a six-foot masonry wall shall be constructed along the east, north and west property lines. 7, That drainage of subject property shall be disposed of in a manner satisfactory to the City Engineer. 8. That the owner(s) of subject property shall pay to the City of Anaheim the appropriate park and recreation in-lieu fees as determined to be appropriate by the City Council, said fees to be paid at the time the building permit is issued. 9. That completion of these reclassification proceedings is contingent upon the granting of Variance No. 2640. . 10. Prior to the introduction of a~ ordinance rezoning subject property, Condition Nos. 1 and 2, above-mentioned, shall be completed. The provisions or rights granted by this resolution shall become ~ull and void by action of the City Counc6l unless said conditions are complied with within one year from the date hereof, or such further time as the City Council may grant. 11. That Condition Nos. 3, 5, 6 and 7, above-mentioned, shall be complied with prior to final building and zoning inspections.
