THAT PETITION FOR CONDITIONAL USF ~ ERMIT NO. ~~~ BE GRANTED I N PART
WHEREAS, thc City Planning Commission o( the City of Anahcim did receivc a verificd Petition for Conditionnl Usc Ycrmil
from THE WILLIAM LYON COMPANY, 366 San Miguel Drive, Suite 201, Ne~iport Beach, California
92660 {Owner) of certain real property situated in the City of Anaheim, County of Orange,
State of California, described as That portion of Lot 5 of Tract 7416 as shown on a map
recorded in Book 311, Pages 37 to 42, inclusive, of Miscellaneous Maps in the Office of
the County Recorder of said County lying southerly of the following described line.
BEGINNING at a point in the westerly iine of said Lot 5, distance thereon Nort`hEast
1°34'27" East 131.00 feet from the southwest corner thereof; thence South 88 25 33
100.00 feet to the easterly line of said Lot 5

WHEREAS, the City Planning Commission did hold a public hearing in the City Hall in the City of Analteim on
Novembe r 25 , 1974, at 2; 00 o'c(ock p.m., notice of said public hearing having been duly given as required by law and in
accordance with the provisions ot the Anaheim Municipal Code, Chapter 18.64,to hear and consider evidence (or and ag~inst said
proposed conditional use and to investigate and make findings and recommendations in connection therewith; and
WHEREAS, said Commission, after due inspcction, investigation, and study made by itself and in its behalf, and aPter clue
consideration of all evidence and reports offered at said liearing, does find and determine the following facts:
1. That the proposed use is properly one for whicli a Conditional Use Pem»t is authorized by Code Sect i on
18,64.020(1)(e), to wit; to permit a two-unit model home complex with waiver of:
SECTION 18.62.045~6) - Maximum siqn area. (10 square feet permitted; 200 sauare feet
proposed)
2. That the above-mentioned waiver was withdrawn by the petitioner since the prcposed
sign is permitted on-site by right for a period or one (1) year, subject to renewal.
3, That the proposed use wiR not adversely affect the adjoining land uses and the growth and development o( tlie area in
which il is proposed to be located.
4. That the sizc and shape of the site proposed Cor the use is adequatc to allow thc fuii development of thc proposed use in a
manner not detrimental to the ~articular area nor to the pcacc; health, safety, and gene~~l welfarc of the Citizcns of the Ciry of
Anaheim.

ENVIRONMENTAL IMPaCT REPORT FINDING:
'That th~ Rlann~ng Commission recomme~ds to the City Council that the subject project be
exempt from the Requirement to Prepare an Environmental Impact Report pursuant to the
provisions of the California Environmental Quality Act.

NOW, THEREFORE, BE I~ESOLUED that the Anaheim City P~nniny Commission does hereby
grant in part subject Petition for Condi*io~al Use Permit, upon the follcwing conditions
which are hereby found to be a necessary prerequisite to the proposed use of the subject
property in order to preserve the safety and general welfare of the Citizens of the City
of Anaheim:
l. That trash ~torage areas shall be provided in accordance with approved plans on
file with the office of the Director of Public Works.
2. That fire hydrants shall be installed and charged as required and determined to be
necessary by the Chief of the rire ~epartment prior Co commencement of structural framing.
3. That subject property shall be served by u~~derground utilities.
4. That drainage of subject property shall be disposed of in a manner satisfactory to
the City Engineer.
5. That public utility easements shall be granted as required by the Director of
Public Utilities. .
6. That this Conditional Use Permit shall remain in full force and effect for a period
of two (2) years from the date hereof or until all of the homes in Tract No. 8828 are
initially sold, whichever occurs first, or such further time as the Planning Commission and;
or City Council may grant.
7. That a bond in an amount and form satisfactory to the City of Anaheim shall be
posted with the City to guarantee the removal of the models in the event the Final Map of
Tract No. 8828 is not recorded.
$, That subject property shall be developed substantially in accordance with plans and
specifications on file with t!~~~: City of Anaheim marked Exhibit Nos. 1 through 9•
9, That Condition Nos. 5 and 7, above-mentioned, shall be compiied with prior to the
commencement of the activity autharized under this resolution, or prior to the time that
the building permit is issued, or within a period of one year from date hereof, whichever
occurs firsl, or such fur4her time as the Planning Commission or City Council may grant.
10. That Condition Nos. I, 3, 4 and 8, above-mentioned, shall be complied with prior
Co final building and zoning inspections.
