A RESOLUTION OC THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM
THAT PETITION FOR VARIANCE N0. Z655 BE GRANTED
WNEREAS, the City Plenning Commission nf the City of Anaheim did receive e veciEied I'etition far Variance
fram THE WILLIAM LYON COMPANY, 36o San Miguel Drive, Suite 201, Newport Beach, California
g2660 (Owner) of certain real property situated in the City of Anaheim, County of Orange,
State of California, described as That portion of Lot 5 of Trac:t 7416 as shown on a map
recorded in Book 3>>, Pages 37 to 42, inclusive, of Miscellaneous Maps in the Office of
the County Recorde.r of said County, lying southerly of the following described line.
BEGINNING at a point in the westerly line of said Lot 5, distance thereo n North
1~34'27" East 81.00 feet from the southwest corner thereof; thence South 88 25'33" East
100.00 feet to the easterly line of said Lot 5.

WH~REAS, the City Planning Commission did hold a public hearing ot the City Hall in the City of Aneheim
on Novembe:' 25, ~974~ at 2:00 o'clock P.M11., notice of said public hearing having been duly given as required
by law a~d in accordance with the provisions oE the Anaheim Municipal Code, Chapter 18.68, to hear and cunsider evi-
dence foc and against said proposed variance and to investigate and make findings end recommendations in connection
therewith; and
1UHEREAS, said Comrnission, after due inspection, investigation, end study mede by itself and in its behalf,
and after due consideration oE ell evidence and reports oEfered at said heacing, does find and detemiine the follo wing
facts:
1. Thatchepetitionerrequests the fol~owing variance from the Anaheim tlunicipal Code, to
establish a 17-lct, single-family subdivision in thP R-2 Z.one;
SECTION 18.04.075 - Requirement that sinqle-familv structures rear ~n arterial
hiahways. (One lot to side on an a!•terial highway)
2. That the above-mentioned waiver is hereby yranted~on the basis that a hardship
would be created if said waiver was not granted.
3, Thet there are exceptional or extreocdinary circumstances or conditions applicable :o th~ propezty involved
or to the intended use of the property thet do not apply generelly to the property or class oE use in the seme vicinity and
zone.
4. That the requested variance is necessary for the preservetion end enjoyment of e substantial property right
possessed by othec pcopecty in the same vicinity and zone, and denied to the property in question.
5 That the requested veriance will not be meterielly detrimental to the public welfare or injurious to the prop-
etty orimprovements in such vicinity and zone in which the property is loceted.
6. That one (1) person indicated hi5, presence at said public hearing in oNposition and
subsequently withdrew his opposition; ~:~d no correspondence was received in opposition to
subject petition.
[NVIRONMENTAL IMPACT REPORT FINDING:
That the Planning Commission recommends to the City Council that the subject project be
exempt from the Requirement to Prepare an Environmental Impact Report pursuant to the

Petition for Veriance, upon the following conditions which are hereby found to be a necessary prerequisite to the pro-
posed use oE the subject property in order to preserve the saEety and general tvelEate ofthe Citizens o~the City of
Anahcim: ,
l. That subject property shail be developed substantially in accordance with plans
and specifications on file ~aith the City of Anaheim marked Exhibit Nos. 1 and 2.
