PC74-235 ~______ A RESOLUTION OF THE CiTY PLANNING C0~1MISSION OF THE CITY OF ANAI IEIM THAT PETITION FOR VARIANCE N0. 2637 f3E GRANTED 1VHEREAS, thc Ciry Planning Commission of thc City of Anahcim did reccivc a vcrified Pctition (or V~riancc Gom I~Ob!ARD AND VILTORIA LOUDON, 30~7 Carob Street, Newport Beach, ~aliforiia 92660 (Ovmers); JOE COOPER, 1500 Adams Avenue, Suite 205, Costa Mesa, California 9262, (Agent) of certain real property situated in the City of Anaheim, County of Orange, State uf California, as described in Exhibit "A" attached hereto and referred to herein as though set forth in full; and WHEREAS, thc City Planning Commission did hold a public hearing at thc City Hall in thc City of Anahcim on Novembe r 25, ~ 974 ~ at 2:00 o'clock p.m., notice of said public hearing hnving been duly ~iven as rcquired by law and in accordunce with the provisions of the Anaheim Municipal Code, Chapter 18.68, 4o heer and consider evidence for and against said proposed variance and to iuvestigate and make findings and recommendations in connection therewith; and WHEREAS, said Commission, attcr duc inspection, investigation, nnd study made by itsclf and in its bchaif, and aftcr duc consideration of all evidcnce and reports off_ red at said hearing, does find and detcrmine thc following facts: 1. Thntthepetitionerrequests the following variances from the Aneheim Municipal Code, to construct a 64-unit apartment cumplex for the elderly in the R~3 Zone: a. SECTION 18.28.050(3)~a) - Minimum floor area per dwelli~a unlt, (j00 sq. ft. required; ~46 to 623 sq. ft. proposed) b. SEGTION 18.28.050(5)~a) - Maximum buildinq heiqht. (2-stories permitted; '4-stories proposed) c, SECTION 18.28.050(10 a 2- Minimum off-street parking. (95 spaces required; 2~ sPaces proposed) d, SECTION 18.28,050(10)(aa2 - Minimum number of covered parkinq spaces. (I~ covered spaces requir.ed; none proposed) e. SECTION 18.32.~5~~2) - Minimum buildinq site area per dwellinq unit. (1,200 sq. ft. per dwelling unit required; 26 s. ft, per dwelling unit proposed) f. SECTION 18.32.~50(3) - Maximum coverage. (~ permitted; ~ proposed) g, SECTION 18,32.~50(4)(a) - Minimum recreational-leisure area. (200 sq. ft. per dwelling unit required; 29 sq. ft, per dwelling unit proposed) 2, That the above-mentioned waivers are hereby granted on the basis that the proposal is a new concept in the City and the waivers did not appear to be excessive or extreme for the proposed type of development; and the Planning Commission generally concurred tha[ a need for such a complex for the elderiy existed in the City. 3. That the Planning Commission directed the Devele~pment Services Department to survey similar complexes and present data concerning parking for this type developmeni to the City Council prior to their review of the subject petition. ENVIRONMENTAL IMPACT REPORT FINDING: That the Planning Commission recommends to the City Council that the subject project be exempt from the requirement to prepare an Environmental Impact Report pursuant to the provisions of the California Enviranmental Quality i~c~. NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does hereby grant subject Petition for Variance, upon the following conditions which ars hereby found to be a necessary prerequisite to the proposed use of the subject property in order to preserve the safety and general welfare oF thA Citizens of the Gity of Anaheim: 1. That fire hydrants shall be installed and charged as required and determined to be necessary by the Chief of the Fire Department, prior te commencement of structural framing. 2. That trash storage areas shall be provl~ed in accordance with approved plans on file wiCh the office of the Director of Public Works. 3. That the structure shall be classified as a Class D-3 occupancy, to provide for fire sprinklers, etc., as stipulated to by the petitioner. 4. That the owner.(s) of subject property shall pay to the City of Anaheim the appropriate park and recreation in-lieu fees as determined co be appropriate by the City Council, said fees to be paid at the time the building permit is issued. 5. That subject property shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim marked Exhibit Nos. 1, 2 and 3. 6.
