A RCSOLUTION OF THE CITY I'LANNING COMMISSIUN OF THE CITY OF ANAliEIM
THAT PETITION FOR VARIANCE N0. 2654 BE GRANTED I N PART
WHEREAS, Nie City Planning Commission of the Ciry of Anaheim did receive a veriGed Petition for Variance from
S and S CONSTRUCTiON, 8383 Wilshire Boulevard, Beverly Hills, California 90211 (Owner) of
certain real property situated in the City of Anaheim, County of Orange, State of
California, descr.ibed as Tract No. 8375 as per map recorded in book 345 pa9es 34 through
3g; Tract No. 5376 as per map recorded in book 345 pages 40 through 43 and Traet IJo. 8377
as per map recorded in book 345 pages 44 through 47; and
WH£:REAS, ihe City Planning Commission did huid a public hearing at the City Hall in the City of Anaheim on
Novembe r 25 , 1974 ~ at 2:00 o'clock p.m., noticc of said public hearing having been duly ~iven as required by law and
in accordance with the provisions of the Mahsim Municipal Code, Cl~a~ter 18.68, to hear and consider evidence for m~d against said
proposed variance and to irvestig:. :: and make findings and recommendations in connection therewiUi; and
WHEREAS, s~ .. o';^r~~~••~lGn, after duc inspection, investigation, and study made by itself and in its behalf, and after due
consideration of all ev~lem: .~ .~ 'ost> ofCered at said hearing, does find and determine the Coilowing facts:
l. Thatthepet•i::., ::r~~"~u~sts the fol lowing variances trom the Anaheim Municipal Code, to
ronstruct seven ~~7) fr~a~standing signs and twenty-four (24) flags:
a. SECTION 1$.62.040 - Requirement that siqns not be located or, public property.
( si ns and 4 flags to be located or. public property)
b. SECTION 18.62.060 - Permitted siqns. (Flags and parking signs not permitted)
c, SEC710N lEi.62.060(b) - Maximum number of siqns.
d. SECTION 18.62.060(b) - Maximum siqn area. (10 square feet permitted; 24 square
• feet proposed)
2. That Waivers 1-a and 1-b, above-mentioned, are hereby granted, in part, to permit
the construction of seven (7) free-standiny signs; said waivers being granted, in part, for
a period of one (1) year, after which time and subject to request by the property owner(s),
consideration may be given to an extension of time.
3, That Waiver 1-c, above-mentioned, was determined to be not required for the pro-
posed signing.
4. That Waiver 1-d, above-mentioned, is hereby granted for a period of one (1) year,
after which time and subject to request by the property owner(s), consideration may be
given to an extension of time.
5. That no flags shall be Qermitted; provided, however, that if standards are ,
developed• or made available by the City pcrmitting the temporary display of flags to
advertise the initial sale of residential units by the developer, then those standards
shall apply to the subject developnent without further consideration by the Planning
Commission.
6. That there are exceptional or extraordinary circumstances or conditions applicable
to the property involved or to the intended use, as granted, of the property that do not
apply generally to the property or class ~f use in the same vicini:y and zone,

• ^7. That the requeste~ariance, as granted, is necess~ for the preservation and
enjoyment of a substantial property right possessed by other property in the same vicinity
and zone, and denied to the property in question.
8. That the requested variance, as granted, will not be materially detrimental to the
public wel`are or injurious to the property or improvements in such vicinity and zone
in which the property is located.
9. That no one indicated their presence at said public hearing in opposition and
no correspondence was received in opposition to subject petition.
ENVIRONMENTAL IMPACT REPORT FINDING:
That the Director of Development Services has determined that the proposed atti'vity falls
within the defir.ition of Section 3.~~, Classll of the City of Anaheim Guidelines to the
Requirements for an EIR and is, therefore, categorically exempt from the requirement Co
file an EIR.
NOW, T4EREFORE, BE IT RESOLVED that the Anaheim City °lanning Commission does hereby
grant in part subject Petition for Variance, upon the.f-ollowing conditions which are hereby
four.3 to be a necessary prerequlsite to the proposed use of the subject property in order
to preserve the safety and general welfare'of the Citizer,s of the City of Anaheim;
l. That the oHner of subject property shall obtain an encroachment permit for the
three (3) signs located on the easterly side of the Grinnell Street right-of-way.
2. That subject property shall be developed substantially in accordance with plans
and specifications on file with the City of Anaheim marked Exhibit Nos. 1, 2 and 3; pro-
vided, howevPr, that no flags shall be permitted unt'il such time as standards permitting the
temporary display of flags to advertise the initial :ale of residential units by the
developer are established by the City, at which time said standards shall apply to'the
subject devel~pment a~ithout further consideration by the Planning Commission.
3. That the Planring Commission grants Variance No. 2654 for a period ot one (1)
year from the date hereof, an~ upon request by the property owner(s), consideration may
be given to an extension of time.
4. That Condition No. l, above-mentioned, shall be complied with prior to the
commencement of the activity authorized under this resalution, or prior to the time that
the biiilding permit is issued, or within a period of one (1) year from date hereof, which-
ev2r occurs first, or such further time as the Planning Com~ission may grant.
