That the proposed use is properly one for which e Conditioaal Use Permil is authorized by Code Sect i o~ 18.52.050(1)(g), to permit a restaurant with on-sale liquor in the M-1 Zone with waiver of: SECTION 18.08.611 - Minimum kitchen area. (2~ of gross floor area required; 20% existing) 2. That the above-rt~entioned waiver is hereby granted for a restaurant with on-sale beer and wine only. 3. That the Planning Commission determined that the industrial complex in which the restaurant is located is not suitable for on-sale liquor and, furthermore, would set an undesirable precedent for similar requests in the future. 4. That the proposed use, as granted, ~..il! not adversely affect the adjo:ning land uses and the qrowth and development of the area in whi~.h it is proposed to be locateci. ' 5. That the size and shape of the site pvoposed ~or the use, as granted, is adequate to allow the full development of the proposed use in a manner not detrimental to the particular area ror to the peace, health, safety, and general welfare of the Citizens of Yhe City of Anaheim. 6. That the Conditional Use Permit, as granted and under the conditions imposed, will not be detrimental to the peace, heaith, safety, and general wel~are of the Gitizens of the City of Anaheim. 7, Tfiat one (1) person appeared at said public hearing in opQosition, and one (1) letter was received representing the owners af nine (9) adjacent industrial buildings in opposition to subject petition. That sidewalks shall be installed along Raymond Avenue as required by the City Engineer and in accordance with standard plans and specifications on file in the office of the City Engineer. 4. That trash storage areas shr.ll be provided in accordance with approved plans on file with the office of the Director of Public Works. 5. That fire hydrants shall be installed anu charged as required and determined to be necessary by the Chief of the Fire Department prior to commencement of structural framing. 6, That the existing structure shall be brought into full Code compliance, including the Uniform Building, Plumbing, Electrical, Mechanical, Fire and Health Codes as adopted by the City of Anaheim; and that all work shall be performed with appropriate building permits and inspections. 7. That subJect property shatl be developed substantially in accordance with plans and specifications on file with the City of Anaheim marked Exhibit No. 1. 8. That Conditlon Nos. 1, 2, 3, ~+, 6 and 7, above-mentioned, shall be complied with prior to finai building and zoning inspections, or within a perfod oF 180 days from date hereof, whichever occurs first, or such further time as the Planning Commission may grant. 9. That this Variance is granted for a restaurant with on-sale beer and wine only.
