RECOM1tA1ENDING TO THE CITY COUNCIL OF THE CITY OF ANAHEIM THAT
PETITION FOR RECLASSIFICATION NQ. 74-~5' ~ 8 EE APPROVED
WHERFAS, the City Planning Commission of the City of Anal~cim did recelve a verified Petition for ReclassiEice-
tionfrom SHOICHI KUBO, 721 South Beach Boulevard, Anaheim, California 92804 (Owner);
OSTRANDER AND KISHIYAMA, 2212 DuPont Drive, Suite F, Irvine, California 92664 (Agents)
of certain real property situated in the City of Anaheim, County of Orange, State of
California, as described in Exhibit "A" attached hereto and referred to herein as though
set forth in full
; and
WHEfZEAS, the City Planning Commission did rtold a public hearing at the City Hall in the City of Aneheim on
Decembef 23, 1974~ at 2•00 o'clock P.hS. notice of said public hearing having been duly given as required by
law and in accordence with the provisions of the Anaheim Municipal Code,~Chapter ~$,03, to hear and consider evidence
for and against said proposed reclassification and to investigete and make findings and recomnfendations in connection
therewith; and
WHEREAS, said Commission, atter due inspection, investigation, and study mede by itself end in its behalf, and
after due consideration oE all evidence and zeports offered at said hearing, does find and determine the following fects:
1. That the petitioner proposes a reclessification of the ahove described property from the RS-A-43,000
(RESIUENTIAL AGRICULTURA~) to the RM-1200 (RESIDENTIAL, MULTIPLE-fAMILY) ZONE.
2. That the proposed reclassification is in conformance with the land use design3tion
of the Anaheim General Plan.
3. Thet the proposed reclassification of subject prope;ty is necessary and/or desireble for the orderly and pro-
per development oE the community.
4. That the pcoposed ceclassificution of subject ptoperty does properly relate to the zones end their permitted
uses ]ocally e~•:eblished in close proximity to subject property and to the zones and their permitfed uses generally estab-
lished througlwut the community.
5, That the petitioner stipulated to the conditional dedication of a strip of land 64
feet in total width for the extension of Hayward Street to the north property line of
subject property along an alignment as approved by the City Engineer.
6. That no one appeared in opposition to subject petition.
ENVIRONMENTAL IMPACT REPOftT FINDING:
That the Planning Commission recommends to the City Council that the subjECt property be
exempt from the requirement to prep~:re an Envirc,nmental Impact Report pursuant to the pro-
visions of the California Environmental Quality Act.

conditions which are hereby founcl to be a necessary prerequisiYe to [he propos~d use of
subject property in urder to preserve the safety and general welfare of the citizens of
the City of Anaheim.
1. That the owner(s) of subject property shall conditionally dedicatc to the City of
Anaheim a strip of land 64 feet in total width for the extension of tlayv~ard Street Co thz
north property line of subject property along an alignment as approved by the City Engineer.
2. That all engineering requirements of the City of Anaheim along Hayward Street
including preparation o` improvement plans and installation of all improvements such as
curbs and gutters, sidewalks, street grading and paving, drainage facilities, or other
appurtenant aiork shall be complied with as required by the City Engineer and in accordance
with standard plans and specifications on file in the office of the City Engineer; that
street lighting facilities along Hayward Street shall be installed as required by the Dir-
ector of Public Utilities and in accardance with standard plans and specifications on file
in the office of the Director of Public Utilities; and that a bond in an amount and form
satisfactory to the City of Anaheim shall be posted ~aith the City to guarantee the in-
staliation of the above-mentioned requirements.
3. That the owner(s) of subject property shall pay to the City of Anaheim the sum
of 60C per front foot along hlayward Street for tree pl~nting purposes, or that the owner(s)
of subject property shall install street parkway trees along Hayward Street in accordance
with City specifica:ions and subject to the approval of the Superintendent of Parkway
Maintenance.
4. That trash storage areas shall be provided in accordance with approved plans on
file with the office of the Director of Public Works.
5. That fire hydrants shall be installed and charged as required and delermined to
be necessary by the Chief of the Fire Department prior to commencement of structural
framing. '
6. That subject property shall be served by underground utilities.
7. Thal a 6-foot masonry wall shall be constructed along the north and west property
lines.
8. That drainage of subject property shall be disposed o? in a manner satisfactory
to tha City Engincer.
g, That a parcel mar to record the approved division of subject property be submitted
to and approved by the City of Anaheim and then be recorded in the office of the Orange
County Recorder.
10. That the owner(s) of subject property shall pay to the City of Anaheim the
appropriate park and recreation in-lieu fees as determined to be appropriate by the City
Council, said fees to be paid at the time the buildiny permit is issued.
11, Prior to the introduction of an ordinance rezoning subject property, Condition
Nos. 1, 2 and 9, above-mentioned, shall be completad. The provisions or rights granted by
the resolution shall become null and void by action of the Lity Council unless said con-
ditions are complied with within one year from the date herenf, or such further time as the
City Council may grant.
12. That Condition Nos. 3, 4, 6, 7 and 8, above-mentioned, shall be complied with
prior to final building and zoning inspections.
