WNEREAS, lhc Ciry Planning Crnnmission of' the Ciry o( Anahcim did rcceive a verificd Petition far Conditional Use Pcrmit
(rom WILLI AND ELISABETH GERLACH, 2117 Hiawatha Avenue, Anaheim, California 92804 (Owner)
of certain real property situated in the City of Anaheim, County of Orange, State of
California, described as Lot 149 of Tract 2118 per Map recorded in Book 63, Pages 36 to
38 inclusive of Miscellaneous Maps in the office of the Corinty Recorde~ of said County
and
WHEREAS, thc City Planning Commission did hold a public hcaring in thc City Hall in thc City oP Anahcim on
Decembe r 23 , 1974, at ?; 00 o'clock p.m., notice of said public hcari~ig having been duly ~iven as requircd by law and in
accordance with the provisions of the Anaheim Municipal Code, Cfiapter 18~26,to hear and considcr evidence for and against said
proposed conditional use and to investi~ate and makr, findings and recc.mmendations in connection thr.iewith; and
9VHEREAS, said Commission, a(ter duc inspection, investig~tion, and study madc by itsclf and in its bch~lf, and after duc
consideration of all evidence and reports offered at said hearing, does find and determine the following facts:
1. That tlic proposcd use is propedy onc for which a Conditionul Usc .~ermit is authorizcd by Codc Seet i on
18.26.050,010 to permit a guest home for senior citizuns in the RS-7200 Zone wit..h waiver of:
SECTION 18.26.067.010 - Maximum si n area. (1 square faot permitted; 71 square
feet proposed
2. That thc propos~;d usc will not adverscly affest the adjoir.ing I~nd ases and the growth and Jcvclopment of thc area in
which it is proposed to be located.
3. That the sizc and shape of the sitc propose~'. for thc use is adequatc to allow thc ful~ devclopment u( thc proposcd usc in a
manner not detrimrntal to the particular arca nor to Uic pcacc, hcallh, safety, ~nd gcncral ~~elfarc of thc Citizens of thc Ciry of
Anahcim.
4. That the granting of the Condi~ion~l Use Partnit under the condilions imposed, if any, will not be detrimental to the peace,
health, safety, and gencral weiPrre of thc CiSizcns of the Ciry of Anahcim.
5, That the aforementione~ waiver is unnecessary since the petitioner stipulated to
the removal of the existing 7~ square foot sign.
6. That the petitioner stipulated to a maximum of four senior citizen tenants, plus
the one resident manager,
ENVVAONMENTAL IMPACT REPORT FINOING:
That the Director of Development Services has determi~ed that th~ proposed activity falls
within the definition of Section 3.01, Class 1 of the City of Anaheim Guidelines to the
Requirements for an Environment.al Impact Report and is, therefore, categorically exempt
from the requirement to file an ElR.

~ NOW, THEREFORE, HE IT RESOLVED thet tne Anahelm City Planning Commiasion does F~ereby grant subfect
petition fnt Conditionel Use Permit, upon tht following conditions which ere heteby found to be a necessary prerequisite
to :he proposed use of the subject property in order to preserve the se[ety and generel welEere aEthe Citizens of tF.e
City of Anah~im:
1. That the owner(s) of subject property shall deed to the City of An~heim a strip
of land 53 feet in width from the centerline of the street along Magnolia Avenue for
street widening purposes.
2, That subject property shall be developed substantially in accordance with plans
and specifications on file with Che City of Anaheim marked Exhibit Nos. I, 2 and ?.
3, That Condition tJos. 1 and 2, above-mentioned, shall be complied with withi~ a
period of 180 days from date herec~ pr such further time as the Planning Commission may
grant.
4. That the petitioner stipulated t~ the maximum of four senior citizen tenants, plus
one resident manager.
5, That the petitioner stipulated to the removal of the 7'-z square foot sign currently
on tfie premises.
