WHEREAS, the City Planning Commission oE the City of Anaheim did receive a verified Petition for Variance from FRED MOHR, 627 North Sabina Street, Apartn~ent B, Anaheim, California 9"1.~305 (Owner) of certain real prc~perCy sicudted in Che i.ity of Anaheim, County of Urange, State of California, described as Lot 2 of Block "B" of Tract 247, as per map recorded in Book 13, Page 5~, Misce!laneous Maps, in the office of the County Recorder of said county ; and WHEREAS, the City Planning Commission did hold a public hearing at the City Hell in the City of Anaheim on December 23, 1974 at 2:00 o'clock P.M., notice of said public hearing having been duly given as required by law and in accnrdance.with the provisions of the Anaheim Municipal Code, Chapter ~$,p3~ to hear and consider evi- dence for and against said proposed variance nnd to investigate and make Eindings and recommendations in connection therewith; and WHEREAS, said Commission, after due inspection, investigation, and study made by itself and in its behai[, and a[ter due consideration of all evidence and ceports of(ered at said hearing, does Eind and detem~ine the Eollowing Eacts: 1. (45% permitted; 52% proposed) b. SECTION 18.32.063.~21 - Minimum side yard setback, (11 feet required; 8 feet, 5 inches proposed) c. SECTION 18.3Z.o66.021 - Minimur~ arkin s ace width, (8,'-, feet required; 8 feet proposed 2. ihat ihere are exceptional or extreordinary circumstances or conditions applicable to the property involved or to L`~e intended use of the property that do not apply generally to tlie property or class of use in t!~c- same vicinity and zone. 3. That the requested variance is r.ecessary far the preservation and enjoyment of a substantial property right possessed by other pcopecty in the same vi~:inity and zone, end denied to the property in question. 4. That the requested variance wiI! not be materially detrimental to the public welFare or injurious to the prop- erty or improvements in such vicinity and zone in which the property is located. 5, That the requested waivers are hereby granted on the basis that the requests are minimal for the use as proposed. 6. That no one appeared in opposition. ENVIRONMENTAL IMPACT REPORT FINDING: That the Director of Development Services has determined that the proposed activity falls within the definition of Section 3.01, Class 3 of the City of Anaheim 6uideli~es to ttie Requirements for an Environmental Impact Report and is, therefore, categorically OEV-66•C exempt from the requirement to file an EIR._~_ RESOLUTION N0, PC74-249 ~ NOW, THEREFORE, 4E~ RESOLVED that the Anaheim City~Plannina Commission does hereby grant subject PeCition for Variance, upon the following cc~ditions which are hereby found to be a necessary prerequisite to the proposed use of the subject property in order to preserve the safety and general welfare of the Citizens of the City of Anaheim. l. That the owner(s) of subject property shall deed to the City of AnahEim a strip of land 10 feet in width from the centerline of the alley for alley-widening purposes. 2. That the owner(s) of subject property shall pay to the City of Anaheim the sum of $2.00 per front foot along Sabina Street for street lighting purposes. 3. That the owner(s) of subject property shall pay tothe City of Anaheim the sum of 60C per front foot along Sabina Street for tree planting purposes. 4. That trash stora~e areas shall be provided in accordance with approved plans on file with the office of the Director of Public Works. 5, That fire hydrants shall be installed and charged as required and determined to be necessary by the Chief of the Fire Department prior to commencemait of structural framing. 6. That subject property shall be served by underground utilities. 7, That the owner(s) of subject property shall pay to the City of Anaheim the appropriate park and recreation in-lieu fees as determined tu be appropriate by the City Council, said fees to be paid at the timetfie building permit is issued, 8. That subject property shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim marked Exhibit No. 1. y. That Condition Nos. 1, 2 and 3, above-mentioned, shall be complied with prior to the cortxnencr_ment of the activity authorized under this resolution, or prior to the time that the building permit is issued, or within a period of one year from date hereof, which- ever occurs first, or such further time as the Planning Commission or City Council may grant. 10. That Condition Nos. 4, 6 and 8, above-mentioned, shall be complied with prior to final building and zoning inspections. THE FOREGOING RESOLUTION is signed and approved by m this 2 rd day ember, 1974.
