PC74-250 A RESOLUTIGN OF THE CITY PLANNING COMM26560~N OF TBE GR N~TEDNAHEIM THAT PGTiTION FOR ~ ARIANCE N0. - WHEREAS, the City Planning Commission of the City of Anaheim did raceive a verified Petition for Vaciance Erom WAYNE HUST, 136 West 5immons Avenue, Anaheim, California 92802 (Okner); GEORGE JEFFERS, 13411 Yorba Street, Santa Ana, California 92705 (Agent) of ceriain real property situated in the City of Anaheim, County of Orange, Stateso~~Candfl2~,'MiscellaneousaMapst 9n~theroffic No. 6184, as per map recorded in book 243. P 9 of the county recorder of said county. ; and WHEREAS, the City Planning Commission did hold a publis heoring at the City Hell in the City of Anaheim on Decemoer 23, 1974~ ~t 2:00 o'clock P.M., notice of said public hearing huving been duly given as required by 1'aw and in accordance with the provisions of the Anaheim Municipal Code, Chapter 18, 0~, to hear end consider evi- dence for and against said proposed variance and to investigate and make findings and recommendations in connection therewith; and ' NHEREAS, said Commission, after due inspection, investigetion, and study made by itself end in its behalE, and aEter due consideration of all evidence and ceports offered nt seid hearing, does find and detennine Ute following facts: 1. That the petitione~ requests a varience from the Anaheim Municipal Code: to eonstruct a housc addition, with waivers of: a. SECTION 18.27.U62.021 - Minimum lot area. (5z850 square feet required; 5,500 sJc uare feet proposed) b. SECTION 18.27.062.021 - Maximum lot coverage. (~ permitted; 37•5% proposed) 2, Thet there are exceptional or extcaordinary r_ircumstances or conditions epplicable to the property involved ot to t}te intended use of the prop2rty that do not ~pply generally to the property or class oE use in Fhe same vicinity and zone: 3. That the reyuested varionce is necessary for the preservation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone, and denied to the property in question. 4, That the reyuested variance will not be materielly detrimental to the public welfare o: injurious to the prop- ecty oc impcovements in such vicinity and zone in which the propecty is loceted. S, That the above-mentioned oaivers are hereby granted on the basis that the request is minimal for the use as proposed. 6, That the granting of the waivers would not be detrimental to surrou~ding properties 7, That no one appeared in opposition. ENVIRONMENTAL IMPACT REPORT FINDING: That the Director of Development Services has determined that the proposed activity falls within the definition of Section 3.G1, Class 3 of the City of Anaheim Guidelines to the Requirements for an Environmental Impact Report and is, therefore, categoricall; uxempt from the requirement to file an EIR. _~_ RESOLUTION ~~G. That subject property shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim marked Exhibit Nos. 1 and 2. 2. That Condition Na, l, above-mentioned, shall be complied o-iith prior to final ~building and zoning inspections.
