'fHAT PETITION FOR CONDITIONAL USE PERMIT N0. BE GRANTED
WHEREAS, the City Planning Commission of the City of Anaheim did receive a cerified Petition for Conditional Use Permit
from WILLIA~~1 A. BAY7.ERMAN, 6980-C Knott Avenue, Buena Park, California 90621, Owner;
TONY SHUEASH, 9722 West KateYla Avenue, Anaheim, California 92804, Agent cf certain real
property situated in the City of Anaheim, County of Orange, State of California, described
as follows:

The North 135 feet of the South 330 feet oi the West helf of Lut 5 of Helen and Lynch°s
Subdivisior. in the City of Anaheim, County of Orange, Stete cf California, as per map
recarded in Book 442, Page 15Fi of Deeds in the office of the County Recorder of los
Angeles County, Celifornia.
Said land is shown on a map filed for record in Book 49. Page 14 of Record of Surveys in
the office of the County ltecordar of said county.

WiiEREAS, the City Planning Commission did hold a public hearing in the City Hall in the City of Anaheim on
I'ebruary 4, 1974, at 2:00 o'clock p.m., notice of said public hearing having been duly given as required by law and in
accordance with the provisions of the Anaheim Municipal Code, Chapter 18.64, to hear and consider evidence for and against said
proposed conditional use and to investigate and make findings and recommendutions in connection therewith; and
WHEREAS, said Commission; after due inspection, investigation, and study made by itself and in its behalf, and after due
consideration of all evidence and reports offered at said hearing, does find and determine the following facts:
1. That the proposed use is properly onc for which a Conditional Use Permit is authorized by Code Section 18.40. 060 ( g) ,
to wit: esteblish sn on-sale 4iquor establishmenL• in conjunction with a restsurant in an
existing ccmmzrciel shopping center.
2. That okher similar estabZishments are locaCed within close proximity to subject
prapertg~
3. That the proposed use will not adversely affect the adjoining lar=d uses and the growth and devclopment of the a:ea in
which it is proposed to be located.
4 e That the size and shape of the site proposed for the use is adequnte to aliow the full development of the proposed use in a
manner aot detrimental co the particular area nc~r to the peace, health, safety, and general welfare of the Citizens of the City of
Maheim. r .
5. That tlie granting of the Conditional Use Pennit under the conditions imposed, if any, will not be detrimental to the peace,
health, safety, and general welfare of the Citizens of the City bf Anaheim.

NOW, THEREFORE, BE IT RESOLVED thet the Anehein City Ylenning Commission does hereby grent subJect
pe[ition for Conditionel Use Permit, upon the following conditions whioh ace heceby found to be a necessery prerequisite
to the proposed use of the subject property in order to pceserve the safety end general welfate ofthe Citlzens of the
City oE Aneheim:
1. That subject property shall be d.eveloped substantially in accordance with
plans and spe~ifications on fiYe with the City of Anahe~m Taarlced Exhibit Nos. 1 and 2
(Rivision I).
