A RESOLUTION OF THE CITY PLANNING COMMISSION ~1452E CITY OF ANAHEIM
THAT PETITION FOR CONDITIONAL USE PERMIT BE DENIED
~VHEREAS, the City Planning Commission of the City of Anaheim did receive a veciEied Petition for Con-
ditionalUse Permitfrom JOSEPH and GR~CL ROMO, 1340 West La Palma Avenue, Anaheim, California
92801,Owners, of certain real property situated in the City of.Anaheim, County of
Orange, State of California, described as follows:
Lot No. 83 of Tract 2161 as shown in Book 63, Pages 33, 34, 35 of Miscellaneous Maps
on file in the office of the Recorder~of Orange County, California.
; and
WHEREAS, the City Planning Commission did hold a public hearing at the CityHa:l in the City of Anaheim
o~ Pebruary /+, 1974 et 2:00 o'clock P.M., notice oE said public hearing having been duly given
as required by law and in accordance with the provisions oEthe Anaheim Municipel code, Chapter 18.64, to hear
end cansider evidence foc and against said proposed conditional use nnd to investigate and make Eindings and
recommendations in connection therewith; and
WHEREAS, said Commission, after due inspection, investigetion, and study made by itself and in its be-
half, and after due considetetion of a11 evidence end reports oEfered at seid hearing, does find and determine the
following facts:
1. Thet the proposed use is properly one Eor whicfi a Conditional Use Permit is authorized by Code
Section 18.64.020(1)(b), to wit: establish a child csre nursery.
2. That the proposed use is not consistent with previous applications of this
nature which have been granted by the Planning Commission in the past.
3. That the large number of children proposed to be cared Eor at the subject
location is not compatible with the surrounding R-1 single-family residential area.
4. That the proposed use would derogate from the surrounding R-1 single-famiEy
residential area and would be inconsistent with the property valuea and thE general
environment of the neighborhood.
5, That a child ca.re nursery presently exists on khe property immediately to the
norr.h of subject property and the propos~d additional child care nursery waul~ create
a potential opportunity to combint ~be two nurseries, th~rs msking the additiona3
nursery increasingly incompatible with the a.rea.
6. That the proposed u3e wi11 adversel~ aFfect the adjoining land uses and the
growth and development of the area in which it ia proposed to be located.
7. That t~ne size and shape of the site proposed for the use is not adequat~
to allow the full development of the proposed us~ in a manner noC detrimental to the
particular area nor to the peo~e, heaith, safety, and general welfare of khe Citizer.s
of the City of Anaheim.
8, That the granti.ng of the Condition~l Use Permit will be detrimental to Che
peace, health, s~fety, and general welfare of the Citizens of the City of Anaheim.

ENVIRONMENTAL IMPACT REPORT PINDING:
That the Planning Commission, in connection with'an Exemption Declaration Status request,
finds and determines that the proposal would have no significant environmental impact
and, therefore, recommends to the City Council that no Environmental Impe~ct StatEment
is necessary.
fIOW, THEREFORE, BE IT RESOLVED that the Anaheim City Plenning Commission does heceby deny subject
Petition for Conditionel Use Permit on the besis of the afocementioned findings.
