A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM
RECOMMENDING TO THE CITY COUNCIL OF~~HF14CI4T2 OF ANAHEAN THAT

WL-IEREAS, the City Plenning Commission of the City of Annheim did receive a verified Petition for Reclassifice-
tiontrom CHESTER H. CHIYA, 8002 DeVries Lane, La Pa2ma, California 90620, Owner; BETTY M,
FRANKLIN, 1303 Temple Hilis Drive, Laguna Beach, California 92651, Agent, of certain real
property situated in the City of Anaheim, County of Orange, State of California, described
as follows:
Lot 4 of Tract No. Y820, in the County of Orange, State of California, as per map recorded
in book 51 pages 3I ar.d 32 of miscellaneous maps, i.n theoffice of the county recorder of
said county.

February 20, 1974, et 2:00 o'clock P~M. notir,e oE seid public hearing heving been duly given es required by. i~
law nnd in accordence with the provisions of the Anaheim Municipel Code, Chepter 18.72, to hear and consider evidence
foc and egeinst seid proposed reclessificetion and to investigete and make tindings end recommendetions in cannectlon
therewith; end
WHEREAS, seid Commission, eEter due inspection, investigation, end study made by itselt nnd in its behalf, end
atter due consideretion of ell evidence and reports offered et seid hearing, does find end determine the following fects:
1. Thet the petitianer proposes e reclessificetion oE the abovc described property from the R-1, ONE FAMILY
RESIDENTIAL, ZONE, Co the C-I, GENERAL COMMERCIAL ZONE.
Z. Thet the praposed reclessification of subject property is necessery end/or desireble (or the orderly end pro-
per development cf the community.
3. Thet the proposed ceclessificetion of subject prope~ty does properly :elete to the zones end their permitted
uses locally established in close proximity to sub;ect property and to the zones and their permitted uses genecally esteb-
lished thcoughout the community.
4. That it was determined that approval of subject reclassification should be made
subject to approval by the City Traffic Engineer of the two accessways to Lincoln Avenue
from subject project.
5, That ~.t was determined that a 20-foot buffer strip for the protection o£ the
single-family resiaential property abutting subject property oa the east was unnecessary
due L'o L•he condiT.ion of the home Chereon and the fact that the property was more in the
character of a commercial zone property.

ENVIRONMENTAL T.MPACT REFORT rINDING:
That the Director of Developmeut Services has determined that the proposed activity falls
within the definition af Section 3.01, Class II of the CiCy of Anaheim Guidelines to the
Requirements for an Environmental Tmpact Report and is, therefore, categorically exempt
from the requirement to file an EIR.
NOW, THEREFORE, BE IT RESOLVEC that tt~e Ansheim City Planning Commission does hereby
recommend to the City Councii of tne City of Anaheim thet subject Petition for Reclassi£i-
cation be spproved and, by so doing, that Title 18-Zoning of the Anaheim Munfcipal Code be
amended to exciude the above descriried property from the R-3, ONE FAMTLY RESIDENTIAL, ZONE,
to the C-1, GENPRAL COMMERCIdi,20NE, upon the following condltions which are hereby found
to be a necessary prerequisite to the proposed use of sub,ject property in order to preserve
the safety and generel weTfare of the Citizens of the City of Anaheim:
1, That sidew32ks shaTl be instaEled eYong Lincoln Avenue as required by the City
Engineer and in accordance with stendard pYans and specifications or~ file in the office
of the City ~ngineer.
2. That the owner(s) of subject property shall pay to the City of Anaheim the sum
of $2.00 per front foot along Lincoln Avenue for street lighting purposes.
3. That the Jwner(s) of subject praperty shall pay to the City of Anaheim the sum
of 60C per fronl• faot along Lincoln Avenue for tree plarting purposes.
4. That :r~sti storage areas shall be provided in accordance with approved plan4 on
file with Che offLce of the Dlrector of Public Wurks.
5. That subjecL• property shall be developed substantially in accordance witlt plans
and specificaticns on file with the City of Anaheim marked Exhibit No. 1; pr~vided, however,
that the two accessways to Lincoin Avenue frar~ the subjecC property shall be subject to
revtew and approvaf by the City Traffic Engineer.
6. t'rtor to the introductior. of an ordinance rezoning subject property, Condition
Nos. 2 and 3, above-mentioned, shali be compYeted. The provisions or rights granted by
ehis resolution shall become null and void by action of the C~ty Council unless said
conditions are compYied with within one year frum the date hereof, or euch further time
as the City Council may gra~t.
7. That Condition Nos. 1, 4, and 5, above-mentioned, shall be complied wlth prior
to final building and zoning inspections.
8. That Cnndil•ional Use Permit Nos. 452 and 552 shall be teimin~ted upon completion
of development of subjecl•. property,
BE IT FURTHER RESOiV~D that the Anbheim City PTanning Cormnission daes hereby recommend
th~t property located ar Linco2n ~1ven4e, from Weatern To Gran~ Avenuea, be reviewed for a
derermination as to whether e Genera'_ Plan Amendment should be initiated to rezone those
preperties with a resolution of int~nt.
