PC74-46 ~ S A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE C1TY OF ANAHEIM THAT PETITION FOR VARIANCE N0. 2576 BE DENIED NHEREAS, thc City Planning Commission of the City of Anaheim did receive a verified Petition for Variance from PHOENIX CLUB, c/o PAUI. GUNNEMAN, 1566 Douglas Street, Anaheim, California 92806, Owner, of certain real property situated in the City of Anaheim, County of Orange, State of California, es described in Exhibit "A" attached hereto and referred to herein as though set forth in full WHEREAS, the C,'ity Planning Commission did hold a public hearing at thc City Hall in the City oC Anaheim on March 4, 5.97/~, at 2:00 o'clock p.m., notice of said public hcaring having been duly given as required by law and in accordance with the •~rovisions of the Maheim Mtmicipal Code, Chapter 18.68, to hear and consider evidence fnr and against said proposed variance and to investigate and make findings and recommendations in connection there:vith; and WHEREAS, said Commission, aCter duc inspection, investigation, and study m~de by itself and in its beltalf, and aCtcr due consideration of all e~9dence and reports offered at said hearing, does find and detcrmine thc following facts: 1. (b) SECTION 18.16.050 5 a- MLr.imum front setbacY (25 feet required, 20 feet ro osed 2, That Waiver 1-a, above-mer.tioned, is hereby der.ied on the besis that the petitianer did not demonstrat•e that a hardship wot~id be created if said GTaiver wea not granted, and it appeared The use w~uld be an exparsion of an existing restaur+ent which. present3y did not meet the deveTopmer.t standards of the City af Anaheim. 3. That there are no exceptionel or extraordinary circums~ences or conditions applicable to the propert:~r involved or to the inCended use of the property that do r.ot apply generally to the property or class of use in the same vicinity and zone. 5. That the requested variance is not necesoary for the preser.v~tion end enjoyment of a substantial property right possessed by other property in the same vicinity and zone, and denied to the properCy in question. 6.
