E. 0'DELL, A-1 Diesel Repair, 535 South Atkinson Street, Anaheim, California 92805, Agent, of certain reap property situated in the City of Anaheim, County of Orange, State of California, described as follows: Lot 10 in Tract No, 4703, as shown on a Map recorded in book 169, pages 25 and 26 of Miscellaneous Maps, recards of Orange County, California. ~. ;and WHEREAS, the Ciry Plunning Commission did hold a public headng In the Ciry Hall in the Ciry of AnahMm on April 1, 1974, at 2: 00 o'clock p.m., notice of said public heuring having been duly ~iven as required by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.64, to hear and consider evidence for and against satd proposed conditional use and to invcstigate and make findings and recommendations in connectlon thercwith; and WHEREAS, satd Commission, after duc inspection, investigation, and study made by itself and in its behalf, and after duc consideration of all evidence and reports offa red at safd hearing, does find nnd determine the following fucts: 1. That the proposed use is propcrly onc for which a Conditlonal Use Pcrtnit is nuthodzed by Codc Section 18. 52.050 (1)(c), to wit: to permit a diesel engine repair aervice in an industrial complex. 2. That the petitioner stipulated that there would be r.o outdoor parking of the v~hicles being repaired and/ot serviced, that all mechani.cal equipment would be kept inside .he building, and that all labor and/or servicing would be performed inside the building. 3. That the petitioner sCipulated thet additional fire protection devices would be pruvided to meet the requirements of the Pire Department and the BuLlding Division. 4. That it was determined that approval of the aubject Conditioaa5. Use Permie should be made sub~ect to the termination of Conditional Use Permit No. 1454. S.,That the proposed use will not advcrscly affect the adjoining land uses and thc growth and dcvclopment of thc area in -hlch it is proposed to be located. 6. That the size and shape of the sitc proposed for thc use is adcquate to allow the full devclopment of the proposed use in a manner not detrimental to the psrtlcular area nor to the peace, health, safety, and gencral weifarc of the CiUzens o(the City of Mahcim. 7. That the grantingof the Conditlanal Use Permit undcr the car.ditions impused, iE' any, will not be detrimental to the peace, health, safety, and general wclfare of thc Citizens of the City of Anahcim. ENVIRONMENTAL IMPACT REPORT FINDING: That the DirecCor ot Development Ser~~ices has detennined that the proposed actLvity falls within the definition of Section 3.01, Clasa 1 of the City of Anaheim Guidelinea to tF:e Requirements for an Environmental Impect Report and is„ i:herefore, categorically exempt from the requirement to fiYe an EIR. PC74-71 DEV-66•O ~ ~ NOW, THEREFORE, BE 1T RESOLVED thet the Anaheim City Planning Commission does hereby grent subject Petition Eor Conditionel Uce Permit, upon the following condiHons which ere hereby found to be a necessery prerequislte to the proposed use oE the subject property in order to preserve the sefety end generel welfece oE the Citizens of the City ot Aneheam: 1. That approval of this Conditional Use Permit is granted subject to termination of Conditional Use Permit No. 1454. 2. That additional fire protection devicea shall be provided in accordance with the requirements af the Fire Department and the Building Division, as stipulated to by the petitioner. 3. That the trash•storage areas shall be provided as determined neceasary by the Snnitation Division. 4. That subject prcperty shall be developed subetantially in accordance with plans and specificationa on file with the City of Anaheim marked Exhibit Nos. 1, 2, and 3. 5. That Condition No, 1, above-mentioned, shall be complied with prior to the commence- ment of the activity authorized under this resolutlon, or prior to the time that the building permit is issued, or within a period' of one year from date hereof, whichever occurs first, or such further time as the Planning Coimnisaion may grant. 6. That Condition No. 2, above-mentioned, shall be complied with prior to final building and zoning inspectiona. 7. That there shall be no outdoar parking of the vehiclcs being repaired and/or serviced, that all mechanical equipment shall be kept insi~e the building, and that all labor and/or servicing shall be performed inaide the building, ae etipulated to by the petitioner. „ THE FOREGOING RESOLUTION is signed end approved by me this lst day of April, 1974.
