PC74-77 ~ A RESOLUTION Of THE CITY PLANNING COMMISSIaN OF 1464 ITY OF ANAHEIM THAT PETITION FOR CONDITIONAL USE PERMIT N0. aE GRANTED WHEREAS, the City Planning Commission uf the City of Anahcim did receive a veriPied Petition for Conditional Use Permit from ROBERT M. LEAVERTON, 16721 Hale Avenue, P.O. Box 4930, Irvine, California 92664, Owner; and MARTIN F. ROSTON, P.O. Box 2013, Orange, California 92669, Agent, of certain real property situated in the City oP Anaheim, County of Orange, State of ~alifornia, as describ~d in Exhibit "A" attached hereto and referred to herein as though set forth in full ;and WHEREAS, the City Planning Commission dld hold a pubUc hearing in the City Hall in the City of Anaheim on April 15, 1974, at 2:00 o'clock p.m., notice of saId public hearing having been duly given as required by law and in accordance with the provisions of the Anaheim Mun(cipal Code, Chapter 18.64, to hear and consider evidence for and against said proposed conditio~ial use and to investigate and maka findings and recommendations ln connectlon therewith; and WHEREAS, said Commission; after due inspection, investigation, and study made by itself and (n its bch~lf, and after due consideration of all evidence and reports offered at s~id hearing, does find und determine the following facts: 1. That the proposed use is properly one for which a Conditlonal Use Pertnit is authodzed by Code Section 18. 52.050 (1)(h), to wit: to permit a non-industrial training center in an existing building in the M-1 Zone with waiver of: SECTION 18.52.060(4)(f) - Minimum number of requir.ed parkin~ spaces 2. That the above-mentioned waiver is hereby granted on the basis chot the requeat ia minimal for the proposed use since there would be u maximum of 35 teachers present for training at any an~ time. 3. 'fhat the proposed use will not adversely affect the adjoining land uscs and the growth and development of' the area in which it is propased to be located. 4. That the size and shapc ot the site proposed for the use is adequate to allow thc full development of the proposed use In a manner nat detrimental to the particular area nor to lhe peace, health, safety, and ge~eral welfarc of the Citizens of the City of Mah^im. 5. That the granting of the Conditional Use Permlt under the conditions imposed, if any, wi11 not be detricnental to the peace, health, safety, and general wclPare of the Citizens of the City of Anaheim. ENVIRONMENTAL IMPACT REPOkT FINDING: That the Dtrector of Development Services has determined that the propoaed activity falls within the definition of Section 3.01, Clasa 1 of the City of Anaheim Guidelinea to the Requirements for an Environmental Impact Report and is, therefore, categorically exempt from the requirement to file an EIR. 1 RESOLUTION N0. PC74-77 CI-G DEV-66•D . ~ ~ NOW, THEREFORE, BE IT RESOLVED thet the Aneheim City P1annIng Commission does hereby grent subject Petltian for Conditionel Use Permit, upon the follawing conditions which are hereby found to be a necessary prereGuisl:e to the proposed use of the subject property in order to pceserve the seEety end generel welEece of the Citizens of the Clty of Aneheim: 1. That the existing sCructure shall be brought up to the minimum standards of the City of Anaheim, including the Uniform Building, Plumbing, Electrical, Housing, Mechanical and Fire Codes as adopted by the City of Anaheim. 2. That subject property shall be developed substant£ally in accordance with plans and specifications on file with the City o£ Anaheim marked Exhibit Nos. 1, 2, 3, and 4. 3. That Condition No. 1, above-mentioned, shall be complied with prior to the commencement of the activity authorized under this resoZution, or prior to the time thet the building permit is issued, or within a perio~ of one ye~r from date hereof, whichever occurs first, or such further time as the Planning Co~isaion mey grant, 4.
