A RESOLUTION ~THE CITY PLANNING COMMISSION OF~HE CITY OF ANAHEIM
THAT PETITION FOR VARIANCE N0. 2587 BE GRANTED
WHEREAS~, the ('ity Planning ~ommission of the City ot Anaheim did receive a verified
Petition for Variance from ELTON C. SNAVELY, 3614 West Ball Road, Anaheim, ~alifornia 92804,
Owner, of certain real property situated in.the City of Anaheim, ~ounty of Orange, State of
California, as described below:
Beginning at the Northeast corner of the West half of tP~e Northeast quarter of the Northeast
quarter of Section 22, in Township 4 South, Range 11 West, S.B.B.M. and running thence
South 0° 10' 40" East, along the Easterly line of said West ha1P, 910.15 feet; thence
So~.~th 89° 40' 40" West 239.30 feet; thence North 0° 10' 40" West 910.15 feet to the North
line of said Section 22; thence North 89° 40' 40" East along said North line, 239.30 feet
to the point of beginning; and
WHEREAS, the Citg Planning Commission did hold a public hearing at the City Hall
in the City of Anaheim on April 15, 1974, at 2:00 o'clock p.m., notice of said public
hearing having been duly given as requirerl by law and in accordance with the provisions of
the Anaheim Municipal Code, Chapter 18.68, to hear and consider evidence for and against said
proposed variance and to investigate and make findings and recoramendations in connection
therewi~h; and
WNEREAS, said Courtnisaion, after due inspection, inveatigation, and study mede by
itself and in ita behalf, and after due consideration of all evidence and reporte offered at
said hearing, does find and determine the following facts:
1. Tt~at the petitioner request~ the following variancea from the Anaheim Municipal
Code, to establish a recreation vehicle storage yard:

2. That':laivers 1-a and 1-b, above-mentioned, are hereby granted on the baeis that
the proposal is an ;.nterim use, being granted for a period of two years after which Cime
upon written requeet by the petitioiier an extension of time may be granted upon approval by
the Planning Commission and/or City Council; provided, however, that an extension of time,
if granted, could be conditioned upen the construction of a 6-foot hig~~ masonry wnll along
the east, west and south property lines.
3. That there are exceptional or extraordinary circumstances or conditions
applicable to the property involved ur to the inCended use of the pronerty that do not apply
generaily to the property or class of use in the same vicinity end zone.
4. That the requeated variance is neceasary for tlie preservation and enjoyment
of e substantial property right pos~essed by other property in the same viciniCy and zone,
and denied to the property in question.
5. That the requested variance will not be materially detrimental to the public
welfare or in~urious to Che property or improvements in auch vicinity and zone in which the
propcrty is located.
6. That it wes determined thet eubject property ahould be serv~d by underground
utilities. ~
7. ThaC it was det~ermined that the existing cha~n link fence located alon~ the
north properCy line should be completely acreened with bamboo alats,
P.NVIRONMENTAL ?MPACT REPORT FINDING:
Thet the Planning Commiartion recommends to the City Couiicil that the subjecC project be
exempt from the requirement to prepare an Environmental Impact Re~ort pursuant to the
previsions of the California Environmental Quality Act.
NOW, THEREFORE, BE IT RESOLVED thet the Anaheim City Planning Commiseion does
hereby grant aubject Petition £or Variance, upon the followin~ conditione which are hereby
found to be a necessary prereqaiaite to the proposed use of the subject property in order
to preserve Che safety and general welfare of the Citizens of Lhe City of Anaheim:
1. That the awner of aubject property ehall conditionally dedicate to the City
of Anaheim a strip of land 5~ feet in width from the centerline of the street a].ong Ball Road
for etreet widening purposea, conditioned upou the need for ultimar,e improvementa as
determined by the City Engineer.
2, That subject property shail be served by underground utilities.
3. That a bond in an amount and form satisfactory to the City of Anaheim ahall be
poated with the City by the owner to guarantee the installation of ultimate atreet improvements,
including street lishCs,
4. That a four (4) foot wide asphalt concrete eidewalk shall be constructed along
Ball Road by the owner.

6. That drainage of subject property stiall be disposed of in a manner
satisfactory to the City Engineer.
7. That appropriate water assessment fees as determined by the Director of Public
L'tilities sha17. be paid to the City of Anaheim prior to the issuance of a bui~ding permit or
within 30 days whic:'iever occurs first.
8, That trash storage areas shall be provided in accordance with approved plans
on file with the Oifice of the Director of Public Works.
9, 7'i:at subject property shall be developed substantially in accordance with plan;
.nd specifications on file with the City of Anaheim marke3 ~xhibit No: 1; provided, however,
that the existing chain link fence located along the north .properCy line shall be screened
with bamboo slats.
10. That Condition Nos. 1, 3, and 5, above-mentioned, shall be compl3ed with prior
to the commencement of the activity authorized under this resolution, or prior to the time
that the building permit is issued, or within a geri~.~v of 90 days from date hereof, whichever
occurs first, or such further tinie as the Planning Cr..mmission may grant.
11. That Condition Nos. 2, 4, 5, 6, 8, ana 9, above-mentioned, shall be complied
with prior Co final building and zoning inspections.
12. That s tiuie limitation of two year~ shall be granted for the use of sribject
propertq and for waiver of,the minimum front setback requirement, and upon written request
by tha pe~itioner, an extension of time may be gr.anted upon approval by the Planni.ng Cummission
and/or City Council; provided, however, that an extension of time, if granted, may be conditiae3
upon the construction'of a 6-foot high masonry wsli along the east, wesC and south property
lines.
