PC 74-8RESOLUTIQN t~) PC74-8 ~ A RESOLUTION OF THE CITY PLAIQNING COMMISSION OF THE CITY OF ANAHEIM TH aT PETITION FOR CONDITIONAL USE PERMIT ~BE GkANTED WHEREAS, the City Planning Commission of the City of Anaheim did receive a vecified Petition for Con- ditionalUsePermitfrom JEFFERSON INVESTMENT AFFILIATES, 201 West Dyer Road, ~uite B, Santa Ana, California 92707, Owner; LE ROV ROSE AND ASSOCIATES, 1440 South State College Boulevard, Anaheim, California 92806, Agent oF certain real,property situated in the City of Anaheim, County of Orange, State of California as described in Exhibit "A" attached hereto and referred to herein as though'set forth in full ; and WHEFtEAS, the City Planning Commission did hold e public hearing at the City Hall in the City of Aneheim a^ January ~, 19]4, at 2:00 o'clock P.M., notice oE said public hearing having been duly given as cequired by law and in accordance with the provisions of the Anaheim ldunicipal code, Chapter 1$.64, to hear and considec evidence for end against said proposed conditional use and to investigate and mal:e findings and recommendations in connection therewith; and WHEREAS, said Commission, aEter due inspection, investigetion, and study made by itself and in its be- halE, and aEter due consideration of all evidence and reports offered et said hearing, does find and determine the Eollowing facts: 1. That the proposed use is properly one for which a Conditional Use Pecmit is authorized by Code Sections 18.64.020(3)(e) and 18.40.060(c) to wit: establish an automobile service station and to establish same within 75 feet of a residential zone, with waiver of: a. SECTION 18.40.020(b)3 - Requirement that a service station must be at the intersection•.of.,two hiahwavs.. (Intersection of a highway and local street proposed) 2. That the proposed use conforms to the Scenic Corridor (5C) Overlay Zone. 3. That the intent of a previous actio~ by the Anaheim City Council was to approve an automobile service station on the northwest corner of the subject intersection, and subject proposal is similar in nature to the prev?ous proposal. 4. That it was determined that said automobile service statio~ is an integral part of the proposed shopping center development at the proposed location, said shopping center being unique in design as illustrated in the submitted plans. 5, That the proposed shopping center development encompassing said automobile ser- vice station will provide sufficient sound buffering to the adjoining R-1 residential zone. 6. That Waiver 1-a, above-mentioned, is hereby granted on the basis that it was de- termined that the petitioner presented sufficient evidence to warrant placement of said automobile service station at the proposed intersection in conjunction with the proposed shopping center development, and that a freeway off-ramp is located in the vicinity of. the proposed location. 7, That the proposeiluse will not adversely affect the adjoining land uses and the growth and development of the area in which it is proposed to be located. 8. That the size and shape of the site proposed for the use is adequate to allow the full development of the proposed use in a manner not detrimental to the particular area nor to the peace, health, safety, and general welfare of the Citizens of the City of Anaheim. ENVIRONMENTAL IMPACT REPORT FINDING: That the Planning Commission, in connection with an Exemption Declaration Status request, finds and determines that the proposal would have no significant environmental impact and, therefore, recommends to the City Council that no Environmental Impact Statement is necessary. NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission ~loes hereby grant subject Petition for Conditional Use Fermit, upon the following conditions which are hereby found to be a necessary prerequisite to the proposed use of the subJect property in order to preserve the safety and general welfare of the Citizens of the Ciiy of Anaheim: (1) That :his conditional use permit is granted subject to the completion of Reclassification No. 73-74-37~ ~oW periding. (2) That subject property shall be developed substantialiy in accordance with plans ar~d specifications on file with the City of Anaheim marked Exhibit Nos. t, 2, 3 a'nd 4.
