A RESOLUTION OF THE CITY PLANNING COT:MISSION 0~465E CITY OF ANAHEIM
THAT PETITIOR FOR CONDITIUNAL USE PERMIT N0. B~ GRANTED
NHEREAS, tlie City Planning Commission of the City of Anaheim did receive a verified Petition for Conditional Use Permit
from WOODBINE CQRP., 838' WiTsh3re Boulevard, Beverly Hills, Californie 90211, Oome=, and
ELIAS JOHN GARCIA, 8383 Wilshire Doslevard, Beverly Hills, Californip 90211, A~enC, of
certain real property situated in the Citp of Anaheim, County of Orange, State of CaLifornia,
as described in Exhibit "A" attached herel•o and referred to herein as though set forth in
full

WHEREAS, the City Planning Commission did hold a public hearing in the City Hall in the City of Anaheim on
April 29, i974 at 2:00 o'clock F.m., notice of said public hearing having been duly given as required by law and in
accordance with the pcovisions of the Anaheim ivlunicipal Code, Chapter 18.64, to hear and consider evidence for and against said
proposed conditional use and to investigate and make findings and recommenda4ions in connection therewith; and
WHEREAS, said Commissiori; aftcr due inspection, investigation, and study made by itself and in iis behalf, and after due
consideration of all evidence and reports offered at said hearing, does find and determine the following facts:
1. That the proposed use is properly one for which a Conditioaal Use Permit is authodzed by Code to wit:
SECTTON 28.64.020(1)(E) - To establish a six-unit ptsnned residential
development with sales office to be used as a model
home complex
2. That the proposed use will not adversely affect the adjoining lan~l uses and the growth and develupment oP the area in
which it is proposed to be located.
3. That the size nnd shape of the site proposed for the use is adequate to zllow the full deve]opment of the proposed use in a
manner not detrimental to the particular area nor te the peace, health, safety, and 3eueral welfare of the Citizens of the City of
Maheim.
4. Thst the grantingof the Conditional Use Permit under the conditions imposed, iP any, will not be detrimental to the peace,
health, safety, and general welfare of the Citizens of the City bf Anahein.
ENVIRONMENTAL IMPACT i.EPORT FINDING:
That the Director of Development Services has determir.ed that the proposed activity fa11s
wi.thin the definition of Section 3.01, CYass 1, of the City of Anaheim Guidelines to the
Requirements f~r an Environmentai Impact Report end is, therefore, categorically exemFt
from the requirement to file an EIR.

T ^NOW, THEREPORE,,BE I~ SOLVED thaL the Anaheim City~ nning Commission does hereby •
grant subject Petition far Conditional Use Permit, upon the foYlowing conditions which are
hereby found to be a necessary prerequisite to the proposed use of the subject property in
order to preserve the safety and general welfare of the Citizens oE the City of Anahei.m:
1. That trash storage areas shall be provided ir accordance with approved plans
on file with the Office of the Director of Public Works,
2. That fire hydra:~ts shall be installed and charged as required and determined
to be necessary by the Cliief of the Fire Dep~:tment prior to commencement of structural
fra;ning.
3. That subject property shall be served by underground utilities.
4. That drainage of said property shall be disposed of in a manner sal•isfactory to
the City Engineer. If, in the preparation of the site, sufficient grading is required to
necessitate a grading permit, r.o work on grading will be permitted between October.l5 and
April 15 unless all required ofE-site drainage f.ecilities heve been installed and are
operative. Positive assurence shall be provided the City that such drainage facilities wi11
be completed Qrior to Octaber i5. Necessary ri.ght-of-w~y for off-site drainage facilities
sha17. be dedicated to the City, or the City Council shall have inil•iated coridemnation
proceedings therefor (the costs of which sha11 be borne by the developer) prior to the
commencement of grading operations. The reyuired drain&ge facilities shall be of a size and
type sufficient to carry runoff waters ori.gir.ating Lrom higher properties through said
property to ultimate disposal as approve3 uy the City Eng'ineer. Seid drainage facilities
sha11 be the first item of construction and shali be completed and be fcnctionaZ throughout
the tract and from the downstream boundary of L•he property to che ulCimete point of disposal
prior to the issuance of any fina7 building inspections or occupancy permits. Drairage
district reimbursement agreeaients may be made available to the deveYopers of said property
upan their request.
5. That grading, excavation, and all other construotion activities sha11 be cun-
ducted in such a manner so as to minimize the poseibility of any sllt orig?nating from this
pruject being carried into the Santa Ana River by storm wgter originating from or fTow3ng
thr~ugh this project.
6. That public utiTity easements shall be granted as required by the Director of
pub~i.c UtiYities.
7. That chis condit3.ond1 use permit shaYY remain in full force and e££ect until
Che PinaT Map of Tract N~~ 8376 has been recorded and Eir.a1 reading of the ordinance
rexoning thls property has been accomplished.
S. That the houses within this model area may not 'be suld ur 6ccupied until the
Picial M~p ~f Trect No. 8376 has been recorded and an ordinance has beer. read rezoning the

10. That a bond in an amount and fozm satisfactory to the City of Anaheim shall be
post._:d with the City to guarantee that aiY lots shall be gracied ir. accordance with the City
Grading Ordinance prior to occupancy of bciidings.

and specifications on file with the City of Anaheim marked Exhibit Nos. 1, 2, 3, 4, 5, 6, 7,
8, T0, 11, and 12.
12. That CondiL-ion Nos. 6, 9, and 10, above-mentioned, sha21 be complied with prlcr
to the commencement of the activity authorized under this resolution, or prior to the time
that the Uuilding permit is issued, or within a period of one year from date hereof, which-
ever occurs first, or such further time as the Ylanning Commission r~ay gr~rit.
