A RESOLUTION CF TH: CITY PLANNING COMMISSION OF THE CI7Y OF ANAHEIM
THAT PE7ITION FOR VARIANCE N0, 2704 BE GRAN7ED,
WHEREAS, the Ciky Pianning Commission of the City of Anaheim did receive a
veriFied Petition for L'ariance from ROBE~T S, BEASLEY, 1336 Benedict Canyon Drive,
Beverly Hills, Ca, 90210 (Owner); P. J. HAILMEYER, 1304 South Magnolia Avenue,
Anaheim, Ca. 92804 (Agcnt) of certain real property situated in the City of Anaheim,
County of Orange, State of California, described as:
The West 82-1/2 feet of the East 247-1/2 feet of the Northwest Quarter of the
Northwest Quarter of the Northeast quarter of Section 23, Township 4 South, Range 11
West, in the City of Anaheim, S,B.B. ~ M.
EXCEPTING THEREFROM the North 396 feet; and
E•1HEP.EAS, the City Planning Comnission did schedule a public hearing at the
City Hall in the City of Anaheim on May 28, 1975, at 1:30 p.m., notice of said
public hearing having been duly given as required by law and in accordance with
the provisions of the Anaheim Municipal Code, Chapter 18.03, to hear and consider
evidence fior and against said proposed variance and to investigate and make
findings and recommendations ir. connection therewith; znd
WNEREAS,, said Commission, after due inspection, investigation and study made
by itselfi and in its behalf, and after due consideration of all evidence a~d
reports offered at said hearing, does find and determine the following.facts:
1. That the %'..ttioner requests the following waiver from the A,naheim Municipal
Code, tQ construc m eight-unit apartment complex: , .
'SECTIJN 18.32.062,012 - Maximum buildinq lieiqht within 150 fee~ of aaricultural
zone, (1 stor permitt~d; 2 srories proposed,
2. That the above-mentioned waiver is hereby 9ranted on the basis that the subject
property is separated from the RS-A-43,000 zoned property to th,e west by a parcel
developed with a multiple-family, two-story dwelling complex; and, further, it was
clarified that the two-story portion of the subject development is in excess of 190 feet
from Lhe adjacent RS-7200 development to the south.
' 3. That the Planntng Commission does hereby determine that the ,granting of this
yariance shall be made subject to development in accordance w.ikh the pr~cise plans, as
submitted,
4, That there are exceptional or extraordinary circumstances or conditions
applicable to the property involved or to the intended use of the property that do not
apply generally to the property or class of use in the same vicinity and zone.
5, That the req~ested variance is necessary•for the preservation and enjoyment of
a substa~tial property righe possessed by other property in the same vicinity and zone,
and denied to the property in'question.
6. That the requested variance will not be mator'sally denrimental to the public
welfare or injurious to the property or improvements in such vici.n'I'ty and zone in which
the property is located, , .
7, That one (1) person appeared at said publie hearing,and submitted a letter in
opposition, and subsequently w~thdrew the opposition on the ~asn~ of ~he plans as sub-
mitted; and one (1) additional letter was received in oppositi:an rto subject petition.
ENVIRONMENTAL IMPACT REPORT FINDING:
~ That the Plannin9 Com~ission recommends to the City Council that the subject projeet
be exempt from the requirement to prepare.an Environmentai Impac*. Report, pursuant to the
provisions of the California Environmental Quality Act,

NOW, 7HEREFORE, SE IT RESOLVED that the Anahtiim City Planniny Commission does
hereby grant subject Pet?tion for Variance, ~p~~m the following conditions which are
hereby found to be a necessary prerequisite ko 'the proposed use of the subject
property in order to preserve the safety andl general welfare of the Citizens of the
City of Anaheim:
1. That this Variance is grar,ced !;ul~,ject to the completion ef Reclassification
Mo. 7~+-75-33, n~w pending. .
2. That subject property shall be developed precisely in accordance wi:h plans
and specifications on file o~ith the City of Anaheim ma~ked Exhibit Nos, l, 2, and 3;
provided, however, that the interior walls of the proposed carports shali be stuccoed,
that enclosed storage cabinets shall be: provided along the rear wall of each carpart,
and that adequate bumper guards shall I~e provided to protect the interior walls of the
proposed carports from damage.
