WHEREAS, the City Plannin9 Comnission of the City of Anaheim did receive a verified Petition for Variance from JOHN LLOYD AND ALICE D. WATT, 546 Hazelwood Street, Anaheim, Ca. 92802 (Owners) of certain real property situated in the Ci•ty of Anaheim, County of Or~nge, State of California, described as: Lot 38 af Tract tVo. 1247, as per map recorded in book 5$ Pages 26 to 28 inclusive cf Miscellaneous Maps, in the office ~f the County Recorder af said County; and WHEREAS, the City Planning Commission did schedule a public hearing at the City Hall in the City of Anaheim on May 2R, 1975, at 1:30 P.m., notice of said public hearing having been duly given as required by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.03, to hear and consider evidence for and agai~~t said proposed variance and to investigate and make findings and recommendations in connection therewith; and WHEREAS, said Commission, after due inspection, investigation and study made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, does find and determine the following facts: 1, That the petitioner requests Yhe following waiver from the Anaheim Municipal Code, to retain an existing house addition: SECTiON 18.26.063.020 - Minimum side yard. ( feet required; 2~ feet existing) 2, That the above-mentioned waiver is hereby granted on the basis that the subject house addition was existing when the prope~ty was purchased and, therefore, a hardship would be created if said ~~aiver were not granted. 3, That the petitioner stipulated to relocating the electrical service meter from the inside cf the house addition to an approved exterior lacation, and to applying for appropriate building permits for said work. ~ , 4. 7hat there are exceptional or extraordinary circumstances o.r conditions applicable to the property involved or to the intended use of the property fhat do not apply generally to the prop~rty or class of use in the same'vicinity and zone. 5, That the rzquestpd variance is~necessary for the preservation and enjoyment of a substantial prcrperty right possessed by other property in the same vicinity and zone, and denied to the property in question. 6, That the requested variance will not be materially detrimental to the public welfare or injurious to the property or improvements in such vicinity and zone in which the property fs located, 7, That no one indicated their presence at said public hearing in opposition, a,id no correspondence was received in opposition to subject petition. ENVIRONMENTAL IMPACT REPORT FINDING: That the Director of the Develo~ment Services Department has determined that the proposed activity falls within the definition of Section 3.01, Class 5, of the City of Anaheim Guidelines to the Requirements for an E~vironmental Impact Report and is, therefore, categorically exempt from the requirement to file an EIR. NOW, THEREFORE, B: tT RESOLVED tha4 the Anaheim City Planning Commission does hereby grant subject Petition for Variance, upon the following conditions o-ihich are hereby found to be a necessary prerequisite to the proposed use of the subject property in order to preserve the safety and general welfare of the Citizens of the City of Anaheim: 1, That: the owner(s) of subject property shall obtain from the City of Anaheim an encroacl~ment perm:t for that portion of the liouse addition which encroaches into portion of the public utiitty easement along the northwesteriy boundary of subject property. . RESOLUiION N0. FC75-1~2 ~ - ~ ~ 2, That the axisting structure shall be brought up to the minimum standards of the City of Anaheim, inciuding the Uniform Building, Plumbing, Electrical, Housing, Mecha~ical and Fire Codes as adopted by the City of Anaheim. 3, Plans shall be submitted to the Building Division showin9 compliance with the minimum standards of the City of ~naheim, including the Uniform Building, Plumbing, Electrical, Housing, Mechanical and Fire Codes as adopted by the City of Anaheim. The appropriate permits shall be obtained for any necessary work. 4. 7hat subject property shall be developed substantially in accordence with plans and specifications or. fil.e with the City of Anaheim marked Exhibif No. l; provided, however, that the electrical service meter shall be relocated from the inside of the house addition to an approved exterior location and appropriate permits shall be applied for in connection therewith, as stipulated to by the petitioner. 5. That Condition Nos. 1, 2, 3 and 4, above-mentioned, shall be completed within 60 days of the date of approval or such furthe~ time as the Planning Commission and/or City Council may 9rant.
