41HEREAS, at their meeting of April 8, 1975, the City Council of the City of
Anaheim directed that an amendment to the Anaheim 1lunicipal Code be initiated to
require all appiications for massage and therapy parlors, modeling agencies, photo-
graphy studios and simiiar uses be processed through the Conditional Use ?ermit
procedure, rather than pe:mitted as a matter of right in all zones and, further,
that an amendment to the Anaheim Dlunicipal Code be initiated to amend the age
provision~s in said Code from 21 years o~ age to 18 years of age, to allow for
control through the Conditional Use Permit procedure of uses requiring that an age
limit be affixed, 18 years of age being the legal adult age; and
WHEF;EAS, the City Planning Commission did hold a public hearing at the City Hall
in the City of Anaheim on May 28, 1975, at 1:3~ p.~n., notice of said public hearing
having been duly given as required by law and in accordance with the provisions of
the Anaheim Municipal Code, to tiear and consider evidence for and against said proposed
ame~dments and to investigate and make findings and recommendations in connection there-
with; and
WHEREAS, said Commission, after due inspection, investigation, and study made by
itself and in its behalf, and after due consideration of all evidence and reports
offered at said hearing, DOES HEREBY FIND:
1, That the age limitation criter~a should be applied for the regulation of
activities such as modeling or photograpf~yagencies or studios, massage or therapy
parlors, and other similar uses, in lieu of "blanket" rastrictions on all such uses,
in order to prevent undue hardship on the conduct of legitimate activities of tfiat
nature, adding to zoning czse loads and, in the City Attorney's opinion, to avoid
enacting legally-questionable ordinances.
2. Tfiat although the standards of all commercial zones presently contain
provisions Fertaining to the regulation of business activities limited'to persons 21
years of age or older, not only is the specified age limit inconsistent with state
laws pertaining to the legal adult age, but locations of references to such age
restrictions are also inconsistently organized within the Zoning Code; therefore, it
~tould appear that amendments should be made to the provisions of all commercial zones,
'as follows: .
a. To lower the age limitation to persons 18 years of age or older, the
current legal adult age; and
b. To reorganize and standardize the location of said provisions within
appropriate chapters to aid in the location of such provisions.
3, That in the recodification of the Zoning Code, certain uses specifically
listed as permitted uses in the CO Zone and permitted by reference in all other
commercial zones, ~aere inadvertently omitted and, therefore, non-substantive "house-
keeping" amendments are also necessary. ,
NOW, TNEREFORE, BE IT RESOLVEL` tl:at the Anaheim City Planning Commission does
hereby adopt and recortmends to the City Cour.cil of the Ci.ty of A~aheim adoption of
amendrnents to Title 18, Zoning, pertaining to the regulation of business activities
related to persons 18 years of age or older on the basis ot the foregoing findings,
and as set forth in "Exhibit A" attached hereto and made a part of this resolution.

That the following sections and subsections of •
Title 18 be repealed:
Sections 18.41.020, 18.41.030, 18.44.035, 18.45.035
and 18.98.020; and
Subsections 18.42.025.070, 18.44.050.040, 18.45.025.040,
18.45.050.040, 18.46.025.060 and 18.48.050.030.
That Title 18 of the Anaheim Municipal Code be amended
by adding the following sections and subsections to read as
iollows:
"18.41.015 P~RMITTED USES,AND STRUCTURES - GENERAL
In the interests of assuring larid use compatability
and the preservation•of the development resources within Anaheim's
office.areas, notwithstandinq any otlier provisions of this Chapter,
the fpllowinq additional limitations shall apply to the conduct of
any use permitted in this zone:
.010 When located within any Scenic Corridor
(SC} Zone, the provisions thereo~ shall apply.
.020 All ases~except automobile parking lots
and such other uses as may specifically be'
exempted hereinafter shall be conducted wholly
within a building.
.030 No structure originally designed'or
intended for residential use shall be used for
commercial activities except as may be approved
by Conditional Use Permit.
.040 No combination of residential and.
commercial uses shall be permitted.
.050• No business wherein any patronage and/or
employment is limited to persons eighteen (18)
years of age or older shall be permitted except
as may be permitted by Con~itional Use Permit.
.060 Uses shali not be conducted so as to be
objectionable by reason of noise, odor, dust,
fumes, smoke, vibrations or other similar causes.

SEVERABILITY. Tne City Council of the City oE Anaheim
hereby declares that should any section, paragraph, sentence or
werd af this chapter of the Code hereby adonted be declared for
any reason to be invalid, it i.s the ~.ntent of the C~uncii that
it would have passecl all othcr,portions of this chapter indepen-
dent of the elinination herefrom of any such portinn as may be
declared invalid. • '
